The actfon of the Federal Radio Com- misslon in ordering Station WTRL of Midland Park, N. J., off the air as of September 1 last, is to be contested in the District of Columbia Court of Ap- peals. Godfrey L. Munter, attorney for the station, yesterday filed a notice of appeal with the District court, claiming’ that the commission exceeded its con- stitutional powers and was prejudiced. The commission, according to Attor- ney Munter, charged in its decision that the broadcasting room of this station was used for the purpose of raising dogs and for charging storage batteries.
