Keith-Miller, Australian aviatrix, has Joined in planning a defense for Capt. W. N. Lancaster, her British flying part- | ner, in event he is indicted for murder of her young fiance, Haden Clarke. “Everything brought out in the case has made Bill (Lancaster) look badly,” the woman fiyer said yesterday as she | worked with Lancaster's attorney on | preliminary defense pians. “There are a thousand things to be brought out in fairness to him that are yet undis- closed.” The grand jurors concluded their in- quiry into Clarke's shooting yesterday, but probably will make no report before Saturday or Monday. | Clarke wes fatally wounded in her | home, where both he and Lancaster were guests a short time after the couple had disclosed to the captain their plans to marry. | Mrs. Keith-Miller has been exoner- | ated by the State attorney. MARY NOLAN PLANS 70 ASK PROBATION Actress and Husband Lose First Move to Evade Serving 30-Day Sentence. By the Associated Press. LOS ANGELES, May 5.—Having lost their first move to evade serving a 30- day jail sentence, Mary Nolan, actress, and her husband, Wallace T. Macrery, today indicated, through their attorney, they would apply for probation or ap- | peal to the State Supreme Court. The pair was convicted of violating the State labor laws. The appellate de- partment of the Superior Court yester- day upheld the conviction and sentences. Miss Nolan, formerly known on the | New York stage as Imogene Wilson, and Macrery were convicted of failing to pay employes of & gown shop they oper- ated in Hollywood Miss Nolan is now on a theatrical tour. She has 48 hours within which to surrender, and five days within which to file an appeal. Her husband is said to be accompanying her on the tour. Both are at libe: n $200 bonds each.
