BAN FRANCISCO, Calif, December 20.—In the three-qudrters of a century that San Francisco has been closely associated with Oriental peoples no Chi- rese servant has ever been guilty of murdering his mistress. Consequently, there was both consternation and omazement when and elderly, wealthy woman was found choked to death in her apartment and police evidence pointed clearly to her Chinese “boy. In spite of some incredulity the pollce quickly ouilt up what they termed a “perfect case” against the Oriental and within a week of the crime the grand jury voted an indictment.’ With a turn as quick and startling, however, as the crime itself, and its rapid police “solution,” the incredulity of persons who could not believe a Chinese serv- ant capable of such an erormous crime has been strengthened by a coroner's jury refusing to name the Oriental and by the grand jury itself rescinding its previous action and refusing to return the indictment. Lui Fook Accused. Who in the carly morning Rosetta Baker, elderly eccentric, weal- thy widow, a woman interested in ama- teur dramatics-and given to the wearing of extravagant jewels and, it is asserted to friendships with youths 'who attracted her interest The police homicide squad readily answered, Lui Fook, 63-year-old Chinese serving boy, who discovered the crime and notified the landlady, who nmflefl the palice ‘The “perfect” case built up by the police and presented to the grand jury corsisted of these items of circumstan- tial evidence: A rubber heel from one of Lui Fook's shoes, and a small piece of human.skin, which police state ex- actly fitted a wound on Lui Fook’s fin- ger, both found at the scene of the murder; two pieces of Mrs. Baker's jew- elry found under rubbish in the base- ment near a room occupied occasionally by Lui Fook; a handbag which a friend of the slain woman identified as having been carried by her the night before her death, found among Lui Fook's belong- ings; a pair of trousers, soiled with blood and with human hairs resembling those of the slain woman, found soaking in a pail of water in the basement near the room sometimes used by Lui Fook. Several Ribs Crushed. The scene of the crime showed evi- dences of a terriffic struggle and a doc- tor's examination of the body showed the chest and several ribs crushed. The Chinere, indignantly denying the crime, has ?mmd that he liked his “missy boss” and asked “why should I kil her? I didn't need money, for I have plenty. If I kill her, why I stay around?. I Chinese and Lol.lld disap- pear; my friends would hide me." Charging frame-up, he denied owner- ship of the trousers, denies hiding the jewels with the assertion that if he had hidden them they wouldn’t have been found, dismisses the handbag as prob- 2bly one some former temant had dis- carded, charges the heel was placed there inunuon-lly to mpl.elu him, and asserts his finger was injured sev- -n.l days previously.on a broken whwo' assertion supported by the apart- mm. house manager. C., DECEMBER 21, 1930—PART ONE. engaged a taxicab early that Monday morning. The legal doubt enveloping the police case is mainly due to the circumstan- tiality of the evidence against Lui Fook and to his physical frailty contrasted with evidences of extreme brutality. Mrs. Baker, though 70 years old, was a strong_woman. Lui Fook is quot.ed as having said on more than one occasion, “Missy Boss will be choked for her diamonds and I will be blamed.” Members of the local Chinese community seem to feel the honor of their race is at stake and are doing all they can to defend Lui Fook and find the “rul" murderer.
