NEW YORK, July 10.—The way was cleared yesterday for distribution of the $6,000,000 which Conrad Hubert, flash- light manufacturer, left to educational and charitable institutions selected by a committee composed of former Presi- dent Coolidge, former Gov. Alfred E. Smith and Julius Rosenwald, Chicago philanthropist. Joseph Horwich, his brother, who re- eived & bequest of $1,000,000, filed an pplication to withdraw his suit ob- men; to probate of Hubert's will. A clause of the will had stated that he was to forfeit the bequest if he con- tested the other provisions. In a statement issued through his torney, Horwich said he was withd: |ing the suit because of his sympathy | with the charitable plans of his brother and because of the ‘“‘great respect and | admiration I hold {or the committee which will choose the charities to which the money will be awarded.” | Surrogate Foley said that as soon as the executors filled formal notice of ‘wllhdrlwfl of the suit he would grant | the petition.
