By the Associated Pre PITTSBURGH, Pa., December 16.— | A gift of $10,000,000 to be expended | through a philanthropic foundation and | 10 be used in the interest of public wel- fare, was announced last night by | Maurice Falk, capitalist and philan- thropist of Pittsburgh. The fund, to be known as the Maurice and Laura Falk foundation, established #S a memorial to Mrs, Falk, is to begin operating early next year. The entire fund, both principal and interest, is to be expended within 35 years, the an- nouncement set forth. A board of seven managers, with | broad powers of discretion given them, will be assigned the task of designating grants for the promotion of religious, charitable, educational, philanthropic | and public interest. By the Associated Press. OKLAHOMA CITY, December 16.— The gas and air lift process for the removal of oils cannot be patentea, John C. Pollock, United States district Judge of Kansas City, has ruled in a decision filed in the case of James McLaughlin, Inc, of Los Angeles against the Amerada Petroleum Co. The California Co. sought to pre- vent the Amerada Co. from using the gas lift process in the Tonkawa field. The process of pumping oil wells by gas lift for separation of the gas from the oil and for separation or gas vapors from gas, as set forth i the patent granted the. California Co., “do_not obtain a new result” and therefor® are not patentable, because of having been in common use before ;h;eémtenfi was granted, Judge Pollock uled, Philip Jones, member of the Los Angeles firm, obtained the patent June 30, 1914. The case was filed July 14, 1925. The gas lift process first was used many years ago in the California fields, the court’s opinion said, and in other places later. CHICAGO, December 16-—Europe— that gave to American agriculture the corn borer—comes forth anew with an- | other pest to pester the farmer; the European starling. 1 Alfred M. Bailey, director of the Chi. cago Academy of Sciences Museum, to- day warned farmers of their new enemy —one that outdoes the corn borer, for it attacks all grains and fruits. Mr. Bailey described the starling as resembling the bluebird in siz>, pug- nacious, hardy, noisy and prolific. The bird thrivestany place, said Mr. Bailey— in holes, in trees and crevices of build- ings, always dispossessing the previous feathered occupants, if any. Like the English sparrow, the star- ling was introduced at the Eastern Sea- board and now nearly every State in the East and South reports large num- bers of the birds. They rove from field to field in large covies and can lay aste to acres in a day, Mr. Bailey said. Always the migration has been steadily westward. They have one redeeming quality— they devour certain ravaging insects. BOMBER IS HELD ed Explosive to Friend Shows Signs of Insanity. By the Assoclated Press. LOS ANGELES, December 16.—At- tendants at the Psychopathic Hospital said yesterday Francis Cadwell, 26- year-old eccentric inventor, who con- fessed to mailing a bomb to Clark Scott at Townsend, Tenn., had become very morose and despondent. ‘The young man was taken to the hospital for observation after post office | inspectors who arrested him could learn no motive for mailing the bomb.. Cad- well explained he held no grudge against his friend and simply wished to study the effects of the explosion. Inspectors and police found material for 12 similar bombs in Cadwell’s room. He told them, they said, that he in- tended to mail the bombs to 12 ac- quaintances. He could not remember their names, he said. Cadwell mailed the package to Scott on November 25. It was so constructed that it exploded when opened. Four days after he had mailed it he sent Scott a telegram signed “Dementia,” in which he warned him not to open a package from Los Angeles. The mes- sage arrived a half hour too late. bystanders received wounds from which they since have rocevered. Scott is in a hospital at Maryville, Tenn. Cadwell, who officers say is an ex- pert mechanic, has been out of work for some time. They characterized him as an inventor with a “twisted” brain. In his room they found a box shaped like a coffin into which he had fitted an apparatus operated by an electric motor. He said when he felt depressed he climbed into the box, closed the lid | and the machine rarefied the alr, giving him mountain ozone. AWAITS COURT ACTION. Whose Bomb Injured His | KNOXVILLE, Tenn,, (P)—Francis Cadwell, eccentric in-| ventor of Los Angeles, Calif,, who con- | fessed to mailing a bomb to Clark Scott, Townsend, Tenn., mechanic, who lost his left hand and three fingers from the right attempting to pry the aluminum box open, is the injured man’s cousin. This became known here yesterday following upon announcement of Cad- well’s arrest at Los Angeles. At the same time, it was learned that Scott had received two letters from Cadwell since recelving the bomb. The first letter was signed “Demented” and said its writer had forwarded the explosive package and hoped Scott would not “be mad with him.” ‘This letter was printed and on sta- tionery similar to that on which the bomb sender had written his telegram telling Scott to throw the package in the river, which telegram arrived 25 minutes too late. . This letter and a second one received by Scott in a Maryville, Tenn., hospital, which inquired about his work in Ten- nessee, furnished clues which resulted in Cadwell's arrest as the bomb manu- facturer.
