September. 14. ~Richard Croker, the late Tammany Hall chieftain, never established a legal residence in this country and therefore his children by his first marriage have no claim to certain valuable Palm Beach property now owned by Bula. Croker, who was his second wife, Federal Judge Halsted Ritter of Miami has rulxd, at- torneys for the widow announced today. Judge Ritter made his decision in a suit brought by Howard Croker, son of the late Tammany chieftain by-his first marriage, against Bula Croker, J. B. Mc- Donald, her agent, and the Palm Beach Estates, a ‘real estate firm. The suit | A was one of several in which the chil- dren of the late Richard Croker sought to attack transfers of property made by Bula Croker in connection with property owned by her husband at Palm Beach. Homestead in Question. Judge Ritter sustained the contention of the defendants that Richard Croker never established a homestead in Flor- ida because his permanent home or domicile, which he established in Glen Cairn, Ireland, in 1904, pever was abai- doned. The children of the late Tam- many Hall chieftain by his first mar- riage sought to establish that certain acean front property in Palm Beach County was the homestead of their fa- ther at the time of his death and that it should descend to them as his heirs, subject to the dower right of his widow, Bula Croker. The property consists of Jand on which is located the Croker dwelling known as the Wigwam, to- gether with more than a mile of adja- | B cent unoccupied property. The Croker children further alleged that the property in question was the homestead of their father and that two deeds and a contract of July 12, 1920, executed between Richard Croker and Bula Croker and the defendant, Mc- Donald, were ineffective to pass title 1o a portion of the property to the exclu- sion of the complainant’s as Richard Croker's heirs. The validity of these two deeds and | §) the contract recently was upheld in a decision by the Circuit Court of Paim Beach County in a suit to cancel the instruments brought by Mrs. Bula Cro- ker, the widow. against McDonald and the Palm Beach Estates.
