Gray-bearded George Sutherland is the first member of the Supreme Court since 1794 who was born on foreign soil. Parental arms brought him to America’s boisterous West from the tranquil countryside of Buckingham- shire, England, when the jurist-to-be was & squirming boy of 15 months. Growing up with the prospering Utah country, a moderately wealthy father sped him on his judicial career by bundling him off to the University of Michigan to study law. Won Friends Readily. George Sutherland went home at 21 with a degree and a polished affa- bility that shortly helped him win a seat in Utah's first Legislature. Washingtor’s House of Representa- | tives was next, and then the Senate, where his agile mind and personal | warmth attracted, among many | others, the friendship of Warren G. Harding. Forced into his first slam-bang political campaign in 1916, the mild- manered Sutherland lost his post to Democrat William H. King. Political friendships are not always | forgotten, however, &and six years later Harding, as President, nominated his Senate crony to the Supreme Court. The United States Court of Appeals held yesterday that a wife could not ap- ; peal from a divorce decree awarded to her husband under which she had re- | ceived alimony p. yments. | This ruling was made by the court in dismissing the appeal of Mrs. Fran- | ces C. Harris, whose husband, David E. Harris of the Chastleton Hotel, had obtained a divorce on grounds of infi- delity. Although the husband was victorious, the trial court ordered him to pay his wife $30 monthly for a reasonable period. | Through Attorney Jean M. Board- | man, Harris told ~ appellate court | that ever since the decree was award- | ed Mrs. Harris regularly had accepted payment of the alimony. He charged | that by accepting the benefits result- ing from the decree she was estopped from challenging its validity. In an opinion wiitten by Chief Jus- tice George E Martin, the Court of Appeals agreed wit' this view. Answering an objection that refusal to accept alimony might leave a wife destitute, the court said the wife was free to apply for temporary mainte- nance during the period in which her appeal was being prosecuted. The court granted Boardman's mo- tion to dismiss, refusing to review the record of the case. . Entombed Men Saved.
