Bs the Associated Press. SOMERSET, Pa., February 25.—Ten | men and two women, who heard two | weeks of sensational testi: v, held | today the fate of Stacy Gunderman, | the 25-year-old trooper who pieaded | eelf-defense in the death of his elderly prisoner, Frank C. Monaghan. The jury could return any one of the following four verdicts for Gunder- man, one of seven peace officers charged with torturing the hotel keeper to death in a “third-degree” question- ing about the slashing of a detective: Second-degree murder, 10 to 20 years in prison; voluntary manslaugh- ter, 6 to 12 years; involuntary man- | slaughter, 3 to 6, and acquittal. The State, represented personally by Attorney General Charles J. Mar- giotti, demanded the second-degree murder verdict “in order that in Penn- sylvania we may no longer have the third degree.” From John Duggan, jr.. chief de- | fense counsel, came a plea for ac- quittal. He described Gunderman as | “only a kid” who had ‘“carried his | eross to Calvary.” “Don’t you be the ones,” he cried to the jurors, “to crucify him.” Gunderman testified that Monaghan attacked -him while they were alone in the Fayette County Bertillon room last September 12. With a ju jutsu hold, he said, he hurled the old man to the concrete floor and then struck | him as he continued to struggle. Margiotti, who led a grand jury in- | vestigation into the 64-year-old hotel | keeper’s death, told the jury that| Monaghan was “put to death inhu-| manely, barbarously by * * * relic of the Dark Ages, a slow, torturing death.” | Dugan admitted “there isn't any question that Monaghan's death re- sulted from external violence * * *! and that violence was inflicted” by Gunderman. But, he added, “in Stacy Gunderman’s mind he was dealing | with a murderer * * * he had to use | force.” COUNTY FARM BUREAU WILL DISCUSS RELIEF Prince Georges Federation Also ‘Will Weigh Pending Leg- islation.
