MISTRIAL HALTS SVITH TESTIMONY " “Slip of Tongue” Brings Ruling in Trial of Two for Extortion. By the Associated Press. NEW YORK, December 17.—Dec- laration of a mistrial in the case of two men charged with extortion yes- terday averted the scheduled ap- pearance of Alfred E. Smith, jr, as & prosecution witness. Finnegan made what he acknowledged to be & “slip of the tongue" by re- ferring to another indictment ac- cusing Krone of enginecering a similar extortion plot against young Smith. The court held that Finnegan's mention of another indictment was “prejudicial” to the defendants and would “prevent them from getting a fair trial” Finnegan was undecided about mov- ing for another trial later. On the stand at the time was Miss Catherine Pavlick, a comely blond who had told of accompanying young Smith to a hotel one night in may, 1933, and of receiving money subse- quently from Krone.
