‘RLEY EXTRADITION ‘BATILE DUE TODAY : Kidnap Suspect to Make Last Effort to Avoid Mich- igan Accusation. ¢ Facing a Michigan kidnaping charge, Jerry Riley, local cigar store proprietor and allegedly the last member of the notorious “Legs” Laman gang still at . large, is scheduled to make a final effort in District Supreme Court this afternoon to prevent extradition. Late yesterday he heard a former gang member, now serving from 20 . t0 40 years in the Michigan State Peni- tentiary, identify him as having par- ticipated in two Detroit kidnapings. In one of the “snatchings,” that af David Cass, 22-year-old son of a < wealthy financier, the victim was beaten to death and the body re- ¢ turned to the family. Charged in Matler Case. , Riley, to whom are listed the aliases of Dennis Regan and Andy Mack, is charged specifically with participation in the kidngping of Charles Matler, Detroit produce man, September 9, 1928 Matler was released upon pay- ment of $14,500 ransom. Through his attorneys, Harry Whalen and William O'Connell, Riley sought to prove yesterday afternoon that he was living at the old Metro- politan Hotel when Matler was kid- naped. Chief Justice Alfred A. Wheat granted a continuance to today to per- mit the defense attorneys to find records of the hotel to support the alibl. Brought to Washington from prison, Ray Andrews, self-admitted racket- teer, definitely identified Riley as hav- ing taken part in both the Matler and the Cass kidnapings. Gang Broken Up in 1930. Assistant United States Attorney Allen J. Krouse and John A. Ricea, assistant prosecuting attorney of De- troit, said the Laman gang was broken up in 1930 and five members sent to prison after they were proved re- sponsible for five kidnapings. . Secretary Morgenthau, who bosses - the Government's liquor enforcement agencies, said yes- terday that “repeal has worked out satisfactorily.” Commenting at his press con- ference on repeal’s second anni- versary, Morgenthau said the col- lection of liquor taxes had pro- ceeded in a satisfactory manner, while the suppression of boot- legging also had been carried on with considerable success. He said overseas smuggling of liquor was now “practically nil.” Morgenthau observed that liquor prices had declined steadily during the two years and forecast that in another two years the warehouse stocks of bonded liquor would be adequate for domestic consumption.
