MODERN D.C, JAL DECLARED NEEDED Mingling of Habitual and First Offenders Held Bad Condition. The demand for a more modern District jail, with adequate facilities for the segregaticn of prisoners, was stressed by Capt. Thomas M. Rives, superintendent of the jail, in an address before the Washington High- lands Citizens’ Association last night. He declared association with habit- ual prisoners was harmful to first offenders. In line with a new building pro- gram, Capt. Rives said would be more ground to enable prisoners to work #nd raise produce, thereby cutting the cost of jail maintenance. The idea of swork on the land would tend to reduce the number of prisoners jailed, in the opinion of Capt. Rives. Suc- cess in management he attributed to humane treatment of the prisoners. ‘The association considered the need for proper sewer facilities. In sev- eral instances, it was said, stagnant pools of water had formed under houses in the neighborhood. W. Earl Nair, president of the association, | named a committee to call on th present head of the Health Depart- ment, Dr. Edward J. Schwartz, and formally present their complaint. Another matter given consideration | was the switching back of street cars marked Congress Heights at Fifth and Alabama avenue southeast, instead of continuing the whole route. The sec- retaty was directed to send a letter of | complaint to the Public Utilities Com- | mission and the Capital Transit Co. Nair said that several gutters and holes in the streets, reported té the District engineers, had been repaired. CONVICTION “I've Just Begun to Fight,” Says Pennsylvania Manufacturer in Pressing Plea. By the Associated Press. PHILADELPHIA, January 4—An appeal intended to test the constitu- tionality of the national recovery act was carried Wednesday to the United States Circuit Court of Appeals by Préd C. Perkins, York, battery B—-7 manufacturer, convicted and fined $1,500 on charges he violated N. R. A. code wage regulations. “I've just begun to fight,” Perkins said after his conviction December 7 in Pederal District Court in Harris- burg.
