Judge Morrow in his decision granted to the Southern Pacifig ab injunction pen- dente lite preventing the Western Pacific from bullding or laying its tracks upon i the strip of land north of the jetty of the San Antonfo estuary, by which it sought ns terminal. W. Morrow | Yesterday Attorneys cm\e- W. Slack, \ ‘Warren Olney and Marcel Cerf, represent- ing the Western Pacific, filed an appeal from this declsion. The appeal contains twenty-five assignments ' of error on the part of Judge Morrow. Most of these are technical, and the main fight wiil probably be made on that part of the decision ‘which determines that the Southern Pa- cific lands extend to the bulkhead line and that they carry a right of access to deep ‘water beyond that. Upon the filing of the appeal Jlldn‘l(ur- row suspended the execution of his deci- sion until the appeal had been decided.
