TOWNSEND TRIAL 1S DUE TOMORROW Defense Plans to Ask for Continuance as Contempt Action Opens. Dr. Francis E. Townsend, elderly head and founder of the Old Age Re- volving Pensions, Ltd., will go on trial before District Court Justice Peyton Gordon tomorrow morning unless his attorneys can persuade the court that the case should be postponed. He is charged with contempt of the House as the outgrowth of an inci- dent last May when he clapped on his hat and defiantly walked out of a committee hearing. Indicted along with him were Dr. Clinton Wunder of New York and John B. Kiefer of Chicago, former aide: to the pension chief, who al- legedly refused to respond to House subpoenas for the same hearing, which was held to investigate old-age pen- sion organizations. Both Wunder and Kiefer, however, gent letters of apology to the House Friday. Nevertheless, both will be arraigned at the same time Dr. Town- send goes before the court. All are at liberty under nominal bail. United States Attorney Leslie C. Garnett disclosed that Dr. Townsend's attorneys, Elisha Hanson and Joseph A. Cantrel, have asked for a con- tinuance and that he told them they would have to present their request to the court tomorrow. Hanson is said to be engaged in a case before the Su- preme Court, while Cantrel is attend- ing a session of the Maryland Legis- lature, of which he is a member. If the case goes over, it probably will be set for February 23, officials de- clared. Garnett and his assistant, Harry L. Underwood, will prosecute the case. "The offense charged is a misdemeanor and is punishable by imprisonment for 1 to 12 months and a fine of from $100 to $1,000. The three defendants were charged In separate indictments. Wunder and Kiefer are charged merely with failure ®o respond to the subpoena, but Dr. *TTownsend was accused both of refus- ing to testify and of walking out of ghe hearing. Board_(;f Trade .
