COAL ACT INVALD, LAWYERS DECLARE Liberty League Committee Defends Right to Ad- vance Opinions. By the Assoclated Press. Defending their right to advance opinions on constitutionality of New Deal laws, the National Lawyers’ Com- mittee of the American Liberty League last night volunteered the opinion that the Guffey coal act is beyond constitu- tional bounds. Although this law, intended to stabil- fze the soft coal industry, has been upheld completely by one Federal judge and partly by another, the commit- tee said it violated the Constitution n that it— (1) “Capriciously and arbitrarily in- fringes upon the individual liberties of Pproducers and employers,” and (2) “Undertakes to regulate activi- ties which are essentially and in- herently local in character.” “Coercive Penalty.” Neither the “pretended exercise of the taxing power through the assess- ment of that which is not in fact a tax but a coercive penalty,” nor con- gressional declaration that the indus- try was “affected with the public interest,” made the act valid, the com- mittee contended. Judge Elwood Hamilton at Louisville recently upheld the entire act, while Justice Jesse C. Adkins of District Supreme Court found that only the wage and hour provisions were beyond constitutional bounds. Both cases are expected to be appealed to the United | States Supreme Court. The committee, whose chairman is Raoul E. Desvernine, counsel for the United States Steel Corp., defended its publication of opinions on the consti- tutionality of New Deal legislation in general as consistent “with the un- broken traditions of our calling.” Assailed by New Dealers. Both administration and labor union officials assailed the group after publi- cation a few weeks ago of an opinion that the Wagner labor disputes act was unconstitutional. “The reports of this committee are only lawyers’ opinions,” the statement said. “They only purport to promote rational and reasoned public discus- sion. They are issued, as every law- yer’s opinion is rendered, with due and respectful deference to the courts to| whom this committee looks as the final expositor of our Constitution and laws and as the great bulwark of our liber- After reviewing the terms of the Guffey act, the committee said “it must be clear to any one familiar with the history of attempted regula- tion of industry and employer-employe relationship that this act goes beyond anything heretofore attempted.” SUNSHINE AT LOW POINT | IN NEW YORK REPORT Nine Wholly Sunless Days Last Month Recorded in Gotham. NEW YORK, December 9.—Gloom— but not the business specie—reached a high point in New York City last month with less sunshine than has| been recorded in the city during No- vember for more than 24 years, it was announced yesterday by David R. Morris meteorologist at the New York Observatory. The sunlight illumination was 21 per eent below normal during the record- breaking month, Morris said, with but 31 per cent of the possible sunshine in evidence. There were nine wholly sun- less days and but two on which the sunshine was 100 per cent. TOM MOONEY PASSES 53D BIRTHDAY IN CELL | Wistfully Expresses Desire to Be at Home and Eat Choco- late Cake. For 19 years, ever since he was ar- rested and accused of bombing the 1916 Preparedness day parade here, Mooney has been behind prison bars. The life-term convict wistfully ex- pressed a desire to be at home with | his wife Rena and eat some of his favorite cake—chocolate. But instead he devoted most of the day to pre- paring new arguments for use when his habeas corpus hearing is resumed today.
