Pumbled and passed about for the past few years as “experimental,” the, Federal Radio Commission on Thursday tossed the turbulent issue back to its chief examiner, Ellis A. Yost, after that | official on Monday had recommended | blanket use of the maximum power of | 50,000 watts for all stations on cleared | channels. Authority Felt Exceeded. The commission did not disclose its reasons for remanding the case to Yost with specific instructions to select from the group of 24 applicants eight sta- | tions which should be awarded the re- maining high-power radio plums. It is] evident, however, that the comymission feels Yost exceeded his authority by su ing that it amend its existing order limiting to 20 the number of channels which may accommodate 50,- 000-watt stations. After presiding over five weeks of hearings on high-power at which the applicant stations put in their cases, Yost held that the most important con- tribution the commission could make would be to lift the ban and permit all 40 cleared channels to carry booming power of 50,000 watts. ! “The commission at this time declines | to consider the advisability of repealing or modifying this order,” said the reso- lution adopted by that body by a 4-to-1 vote, with Commissioner Harold A. Lafount dissenting. Now only 10 stations are on the air with 50,000 watts. Five others have | construction permits for transmitters of | this power. Yost Faces Trying Task. Yost faces a trying task. In his re- port he said it would be impossible to choose between some of the high-grade | plicant stations. Now he must do it. &n, if the commission sticks to its; guns and grants only sufficient appli-| cations to fill the existing vacancies under its order, there will be a grand | march to the courts by the stations denied.
