BAL’ GAMBLER PREFERS LETHAL CHAMBER Instructs Attorneys Not to Ask Board for Commuta- tion of Death Sentence. By the Associated Press. RENO, Nev,, April 25.—R. H. White, 42, a gambler, yesterday told his attor- neys he would “rather take the gas” in the new lethal chamber at the Ne- vada Penitentiary than spend the rest of his life in prison and instructed them not to ask the State board of pardons for a commutation of the .death sen- tence. Judge L. O. Hawkins of Winnemucca, within a few days, will set the date for the execution, and county authori- ties said the gambler probably would be executed next month. ‘White, who was convicted of the mur- der of Louis Lavell, another gambler, at Elko last year, will be the third man to enter the lethal chamber at the peni- tentiary to pay the extreme penalty for murder. The Nevada Supreme Court yesterday refused a request for a re- hearing of his appeal. “Let’s get it over with, and the sooner the better,” White told his attorneys as he sat in his cell. By the Assoclated Press. ‘TUCSON, Ariz., April 25.—A descrip- tion of planet “X,” heralded as the ninth planetary member of the solar system, in which the recently discovered astronomical body was said to be about the size of the earth, and to require 3,200 years to complete a circuit of its orbit, is available to the public for the first time. Dr. E. C. Slipher, Lowell Observatory astronomer, one of those directly con- nected with the recent discovery of the transneptunian body, explamed the se- crets of the planet in layman’s language after describing it to delegates of the eleventh annual convention of the Southwestern section of the American Association for Advancement of Science. Here are the chief known facts con- cerning the astronomical body, as pre- sented by Dr. Slipher: Distance from the earth—41 astrono- mical units, or 1,335,000,000 miles. Mass—Known to be smaller than at first believed, but not computed. Tenmtlvely believed about the same as the Ol‘bib—Ellip(lca! its plane inclined to that of the other major planets at about 31 degrees, 21 minutes. Size of orbit—Long diameter roughly 433 astronomical units, or 433 times 33,000,000 miles. Time required for complete circuit of orbit—3,200 years. Length of time to remain in view of earth—Probably a century more. Time it will then remain hidden— Roughly 3,000 years. Photographic characteristics—Sharp deflnman under all circumstances. “In our minds,” said Dr. Slipher, referring to recent articles in scientific publications, “we are quite convinced that this is a planetary object quite dis- M.nct from a comet or an asteroid. “The only reason for suggestions that the new body might be cometary is to be found in the elliptical orbit, apparently like the orbits we get from comete.” ‘The astronomer explained further, in reference to both comets Enfl asteroids, that observation of planet “X” has now been of long enough duration, with great enough clarity to demonstrate that were all the asteroids, or minor planetary bodies, and all the comets in the known heavens to be rolled into one mass, compressed to the density of the earth and placed in the position of planet “X” the resultant body would not be as bright. ASTRONOMERS LAY PLANS FOR ECLIPSE Finishing Touches Are Being Put on Months of Work in Laboratories. By the Assoclated Press. CAMPTONVILLE, Calif, April 25.— In peaceful Oak Valley, as silent almost as the phenomena they have come to photograph, Lick Observatory and other astronomers are taking strategic posi- tions for a concerted exploration of the eclipse of the sun April 28, ‘Within and along the computed line of the shadow which the moon will lay upon the land by passing between the sun and the earth at the rate of about 1,200 miles an hour, the finishing touches are being given to months of preparatory work. Laboratories and dark rooms have been built and frames erected for the mounting of telescopes and spectroscopes. From the Naval Observatory at Mare Island electric time signals automat- ically will drop a sensitized plate a frac- tion of an inch each eighth of a sec- ond so spectroscores will photograph what is equivalent to a moving picture of the atmosphere of the sun during the final moments of pamxl eclipse and the entire period of total eclipses. From airplanes near San Francisco Dr. H. M. Jeffers of Lick Observatory will endeavor to photograph the exact path of the shadow on the ground and by chronometers regulated by radio the precise time of beginning and end of total eclipse will be recorded to make possible the correction of observations governing the moon's motion. ALLEGED COMMUNISTS REFUSED BAIL BY COURT Georgia Assistant Solicitor General Declares State Will Demand Death Penalty. By the Assoclated Press. ATLANTA, Ga. April 25.—Judge Edgar E. Pomemy in Fulton Superior Court Wednesday denied bail to Joe Carr and M. H. Powers, alleged Com- munists charged with attempting to in- cite to insurrection, a capital offense under Georgia law. Assistant Solicitor General John H. Hudson informed the court the State will demand the death penalty when the men are brought to trial. He also sald the men had announced plans for a May day demonstration in case they are released. The two young men were arrested after a meeting several months ago, during which they were alleged to have advocated Communistic theories and have distributed circulars described by| 714 13th St. police as favoring insurrection.
