Aeronautics Act Followed *, Years of Wrangling and Study Sought to Correct Accidents, Low Mo BACKGROUND— President Roosevelt's fourth reorganization plan, now before Congress, orders the Air Safety Board abolished and the Civil Aeronautics Authority transferred into the Commerce Department. Nationwide opposition threatens to result in a non-partisan fight of unusual bitterness when the plan reaches the halls of Con- gress. This is the fourth of a series of articles dealing with the background of this controversial subject. By JOSEPH S. EDGERTON. Five years of political wrangling and inefficiency in the Bureau of | Air Commerce of the Commerce De- partment, accompanied by impaired morale, accidents and financial loxses on the part of the domestic air transport lines, were brought to a close in August, 1938, when the Civig Aeronautics Act became effec- tive, creating the independent Civil Such Evils as rale and Financial Losses Commerce Commission be given power to regulate air carriers. There was serious disagreement among the Federal departments over this proposal, and the plan was side- tracked eventually in favor of the proposed new Authority. 1 The declaration of Congressional policy indicated that the new aue thority was expected to regulate the aeronautics industry in the public interest, taking into consideration the needs of the industry and the best interests of the people of the United States The act created a five-member inulhority as an independent agency responsible only to Congress. This authority exercises quasi-legislative | and quasi-judicial functions created | under the act. Within the author- {ity, the office of administrator was | created to handle the executive | functions created by the act. Inde- | pendent of the authority and the administrator is a three-man Air Safety Board, created to investigate accidents and recommend means to eliminate accidents. Authority Members Protected. Members of the authority are removable by the President for cause only, while the administrator and members of the Safety Board are removable at the will of the President. To the new authority Congress transferred the Bureau of Air Com- merce from the Commerce Depart- ment and the air mail division from the Interstate Commerce Com- mission. The administrative plan for the new authority was something new in the Federal set-up. It is impor- tant to note, in view of the Pres- ident’s new reorganization order, that the pattern is similar in some respects to the administrative set-up provided in the 1ll-fated earlier re- | organization plan of the Brownlow | Committee. Statements were made | by several members of Congress at the time that the Civil Aeronautics | Act was expected to serve as a | springboard for a plan by which the | | President might gain control over | executive functions of administra- tive agencies exercising quasi-legis- lative and quasi-judicial functions. It is not often that any legislation receives such careful consideration or that legislation is drawn with such definite ends in view. | Pressure and Investigations. It must be remembered that throughout this period. civil aviation was a thorn in the side of Congress. Because of the unhappy state of affairs ip the Bureau of Air Com- merce and the Commerce Depart- ment and the unsettled state of the industry which ensued, Congress ordered one investigation after &n- other. Members ¢f Congress who' &howed any interest in aviation mat ters at all were harassed and worn | by pressure from the conflicting aviation camps. The net result was a determination on the part of all interested parties to end once and for all through the medium of the new Civil Aeronautics Act the evils | and ills of civil aviation. | One of the greatest evils which | cried for remedy was the accident | toll which marred the operation of domestic air transportation and in- | Jured public confidence in the new | transportation medium.
