A--22 =% WITNESS RECALLS BLACK CULT PLOT Yells of Events Preceding Group’s “Execution” of Poole. By the Assoclated Press. DETROIT, September 24.—Emer- son Becker testified today at the trial of 12 men charged with the Black Legion killing of Charles A. Poole that members of the secret society, meet- ing a few hours before the “execu~ tion,” had howled for Poole's death. Becker's testimony coryoborated Payton Dean’s version of events pre- the crime and disputed the stories of Harvey Davis and Ervin D, Lee, two of the defendants, that Dean was the sale instigator of the death plot. The witness said he attended the meeting with Elmer Anderson, who is being sought on a perjury charge as & result of his testimony for the de- fense yesterday. Becker testifed to- day for the State. “Davis was presiding at the meet- Ing,” Becker said. “We saw Dean hand a note to Davis, and Davis said, ‘Fellows, what do you think of a Catholic so-and-so who beat his wife when she was going to have a baby and got drunk and kicked her so she had to-go to a hospital?’ Testifies to “Lot of Yelling.” “There was a lot of yelling. Some of them wanted to beat up this fellow. Some said to kill him. Every- body was yelling and hollering. I HARVEY DAVIS. Under cross-ezamination at | Detroit yesterday, Davis reit- erated that the Charles A. Davis said, ‘Any of you fellows who want to know what happens, just come along and follow us.’” Becker said he and Anderson fol- fowed the automobile caravan, but did not reach the country road where Poole was shot to death by Dean because they were sidetracked by the raising of a drawbridge over the Rouge River, The accusation of wife beating egainst Poole has been shown to be false. Anderson disappeared late yester- day while Circuit Judge Joseph A. Moynihan was ordering perjury pro- ceedings brought against him. Perjury Is Charged. Judge Moynihan, calling attorneys Into his chambers at & recess yester- day, said: “I cannot permit testimony of Witness Anderson to remain on the record. He palpably committed perjury emur in this court or before the grand 'l'he trial judge referred to Ander- son’s grand jury testimony, read into the record earlier in the trial, in which Anderson supported the State’s contentions that Poole’s slaying was plotted at a meeting of the Black Legion. On the stand yesterday An- derson testified he attended the meet- ing, buf declared he did not hear any one suggest that Poole be killed. Anderson, when confronted in cross- examination by Assistant Attorney General Chester P. O'Hara, first tes- tified he had given false information before the grand jury because he feared police brutality. . Called upon to decide whether he had testified falsely before the jury or was doing #0 on the stand, Anderson stated his grand jury testimony was u-ue n its principal points.
