HARRISONBURG, Va., November 11.—In a case in which §enator Harry Flood Byrd of Virginia, Democratic | critic of many New Deal measures, joined with other creditors in attack- | ing the law, Judge John Paul in| United States district court here held | the amended Frazier-Lemke farm mortgage act unconstitutional in Vir- ginia. Senator Byrd in discussing the de-| eision made it plain he was acting in the case not in a personal capacity, but as guardian of the estate of the| late Hal Flood, Virginia Representa- | “tive. ., The decision was announced yester- | “'day after Judge Paul had departed for | ‘Abingdon, where he will open a new | .term of court. Declared to Take Away Rights. Judge Paul said in the lengthy opinion that the act takes away sub-‘ + stantial property rights guaranteed | creditors under Virginia statutes, and the amendments do not overcome all | of the objections raised by the Su-| .preme Court of the United States in holding the original Frazier-Lemke | Mmct unconstitutional. | The decision.was handed down in| dismissing the proceedings under which John Clayton Sherman, Mary | Elizabeth Sherman and James Strother Sherman, previously adjudicated} bankrupt, sought to retain their apple | orchard property in Frederick County, Va., under provisions of the Frazier- Lemke act. The creditors attacking the consti- tutionality of the law were H. F. Byrd, guardian; Farmers and Merchants’ National Bank and Trust Co. of Win- chester, Va., and Mattie W. Cooper, Winchester. All hold bonds secured by deeds of trust on the Sherman property. The indebtedness was incurred from | 1922 to 1931. Prior to the passage of the original Frazier-Lemke act, the bond held by Mr. Byrd as guardian is dated September 4, 1922. Position of Court. | The Supreme Court in the case of | Louisville Bank vs. Radford, which | resulted in the original Frazier-| Lemke act being declared unconsti- tutional, called attention to the fifth | amendment to the Constitution and that the Frazier-Lemke act, by its| 'terms applied only to debts existing | at the time of enactment, and held that because it was retroactive and took away rights of the mortgagee in | specific property it was in contraven- | tion of the fifth amendment and,| therefore, invalid, Judge Paul pointed out.
