FINANCIAL: TEND DOWNWARD Majority of Small Losses Recorded—U. S. Issues Are Irregular. BY BERNARD S. O'HARA, Associated Press Financial Writer. NEW YORK, December 11.—Prices followed a downward slant from the best levels of the forenoon and in the final hour the corporate bond list showed a majority of small declines. While United States Governments were mixed the Treasury issues hard- ened to show gains of 1-32d to 5-32ds | of a point. A lime further selling in low- prlced rails brought some fractional losses in the loans of Alleghany Corp., Chesa- peake & Ohio, Missouri Pacific and Frisco. Italian 7s rallied about a point to 391, and like gains were shown by Polish 7s and Japanese 7!:s. Th rest of the foreign list was mixed. DIVIDENDS " ANNOUNCED NEW YORK. YEAREND SELLING 10 BE RESTRICTED Changes Made in Revenue Act by Last Session of Congress Cited. By the Associated Press. NEW YORK, December 11.—The usual year-end selling of securites to | register losses for tax purposes is ex- | " | pected to be greatly restricted this year because of changes made in the revenue act at the last session of Con- gress. As the act now stands, &n excess of capital losses over capital gains is de- ductible from ordinary income only to the extent of $2,000, and stocks and bonds are subject to the same rules as soou | other capital assets. Other changes made in the act provided that property need not be held for more than two years in order to constitute a capital asset and an excess of capital gains over capital losses is taxable at the regular rates without limitation. In the case of individuals, the per- centage of gain or loss which is recog- nized depends upon the length of time the property was held prior to sale, capital asset has been_ held for less per cent if held for more than 10 years. In the case of corporations, however, actual gains are matched against actual losses, regardless of the length of time the proprety was held. Since it is no longer possible to carry over losses from one year to apply against a succeeding year's in- come, there is no purpose in register- ing for tax purposes a net capital loss for the current year in excess of $2,000, and on this basis the selling which normally creates considerable market irregularity in the final weeks of the year is expected to be of con- siderably smaller proportions this year than in the past. Another provision of the tax laws having a potential bearing on price movements in stocks near the close of the year is that levying a heavy tax lon undistributed net income of cor- porations adjudged to be unreasonable in amount. While not new, having been contained in revenue legislation for many years to prevent evasion of personal income through use of the personal holding company, the recent disbursement of a number of extra dividends has served to bring about extensive discussion of this phase of the revenue law and its probable effect on directors’ action in forthcoming dividend meetings. December 11 (.—Produce is | WHOLES SAGS MODERATELY Fertilizer Association Finds Decline of Three Points to 75.5 Level. ‘Wholesale commodity prices declined moderately during the latest week, according to the index of the National Fertilizer Association. When com- puted for the week ended December 10 this index fell off 3 points, declining from 75.8 to 75.5. The index advanced 1 point during the preceding week. A month ago the index stood at 75.1 and a year ago at 68.8. The record low point reached by the index was 55.8, recorded in March, 1933. (The ll.tolore)e-ym average, 1026-1928, equals ‘The trend of prices was mixed dur- ing the latest week, with three of the groups in the index declining and four advancing. In the preceding week only one group declined and four ad- vanced. The declining groups for the latest week were foods, fuel (includ- ing petroleum and its preducts) and textiles. The advancing groups were grains, feeds and live stock, metals, fats and oils, and fertilizer materials. The two most heavily weighted groups, foods and fuel, showed marked de- clines. During the latest week the prices for 19 individual commodities declined, while the prices for 33 advanced. In the week preceding there were 8 de- clines and 30 advances; two weeks ago there were 21 declines and 28 ad- vances. Fourteen commodities in the grains, feeds and live stock group ad- vanced during the latest week, while only one, choice cattle, declined.
