. ARRESTED ON SIGHT, CAPONE IS JALED Prisoner for Second Time in Miami—Authorities Firm on Ouster. By the Assoclated Press. 'MIAMI, Fla., May 14—“Scarface Al” Capone slept on a jail cot last night, a prisoner for the second time since Miami authorities determined to cut short his stay here by arresting him on sight. Seized while attending a boxing bout, the harrassed gang leader was placed in jail at an hour which his attorneys found to be too late to locate a judge for a habeas corpus hearing. ‘When Capone first was arrested last Thursday on a technical charge of “in- wvestigation” Miami police described their tactics as an adoption of the “Chicago plan” of picking up gangsters when- ever they are seen on the city's streets. In detaining Capone overnight, how- ever, they outdid the authors of the acheme, for although Chicago police fre- quently questioned Capone, his only jail experience was his 10-month sentence in Pennsylvania for carrying concealed ‘weapons. “Three companions were held with Ospone. The police order to arrest Capone on sight was suspended tem- porarily early this week when he peti- tioned the Circuit Court for an in- junction forbidding his arrest without a warrant, The order again was placed in force, however, when Judge Thomp- son declined to hear the petition until a similar action on file in Federal Court was withdrawn. Proceedings to padlock Capone's palatial Palm Island estate as a nuisance are pending in State courts. . Rustburg, Va., Woman Dies. Bpecial Dispatch'to The Star.
