Snook, now in the State Penitentiary awaiting death in the electric chair for the murder of Theora Hix, Ohio State co-ed. INQUIRY BOARD REFUSED. Justice Marshall's statement came on | the heels of the decision of the Second District Court of Appeals denying Snook a new trial. After a conference with attorneys for Snook and Prosecutor John J. Chester, jr., Justice Marshall instructed the defense to file a motion for leave to enter a petition in error, alleging mistrial, and a petition of right. It is expected that the defense in the petition for right will set forth Federal grounds for an appeal to the United States Supreme Court. The Court of Appeals, today found that Snook had been mistreated by the prosecutor before confessing and that the prosecutor had used improper lan- guage in summing up the case before the trial jury.
