NEW YORK, September 27.—Federal Judge Thacher yesterday dismissed a complaint in which leading motion pic- ture producers and distributors, includ- ing Paramount, Fox, Metro-Goldwyn- Mayer and First National were charged by the Government with conspiracy in restraint of trade and violation of the Sherman anti-trust law. In the suit the Government attacked a set of credit rules adopted by the defendants for the avowed purpose of reaucing losses they had been suffering through the transfer of theaters to new owners pending the performance of ex- hibition contracts. The rules required each distributor to demand, under certain circumstances, security not exceeding $1,000 when the new owner refused to assume the con- tracts made by the previous owner. Ruling of Judge. Judge Thacher ruled that “all the badges of unreasonable restraint are lacking” in the case. “There is no suppression of competi- tion, nor any attempt to monopolize,” his opinion said. “No one has com- plained except the Government. No injury to individual traders or to the public generally is disclosed. On the contrary, serious trade abuses have been eliminated, and both exhibitors and dis- tributors have been benefitted.” Judge Thacher found that the pur- pose in requiring the deposits was to induce the new owners to assume and perform the old contracts. Edwin P. Grosvenor, of counsel for the defense, said after the decision was made public: Decision Held Important. “The decision of Judge Thacher is of great importance to business men and credit associations. “In 1928 a typical year, there were 4.612 ‘theaters transferred out of ap- proximately 25,000 motion picture the- aters in the United States. LONDON, September 27.—A dispatch to the Daily Mail from Cairo, Egypt, said the Arabian legation there had an- nounced that Ibn Saud, King of the Hedjaz and Emperor of Nejd, had sup- pressed most of the outbreaks headed by rebellious Wahabi chieftains, Two hundred captives, who had been re- prieved on two previous occasions, had finally been beheaded. A dispatch to the same newspaper from Jerusalem said the Wahabis in the north were taking advantage of the embarrassment of Thn Saud to raid vil- lages on the frontier of Transjordania.
