After hearing the report, which se- verely criticized State's Attorney George D. Carbary of Kane County, Circuit Judge John H. Newhall of Aurora and members of -Carbary's staff, the House of Representatives voted to defer action | until today. Judge Is Censured. 1 The committee censured Judge New- | hall for campaigning for Carbary in| 1928 when Carbary was seeking the | Republican nomination for States' at- torney. “After the nomination of said Car- bary in the April primary the lawless- ness theretofore _existing in Kane | County was succecded by a period of | Jawless law enforcement,” the report stated. Carbary’s chief investigator was de- scribed as “a consort of the most no- torlous vice lord of Kane County” and his other investigators as “of the low- est type, consisting of ex-convicts and persons, who, while under indictment, were released from jail by the State's attorney for the purpose of acting as prohibition investigators.” Disqualified Self. Carbary, the report declared, had definitely disqualified himself in the De King case by publicly announcing the morning after the slaying that he was “100 per cent behind the officers” who raided the De King home on a per- jured warrant, clubbed Joseph De King unconscious and shot Mrs. De King. ‘While conducting the grand jury in- vestigation into the slaying, the report sald Carbary “suppressed material evi- dence, placed other evidence in an un- natural and untruthful light and placed evidence wholly immaterial to the mat- ter in investigation for the sole purpose of s arousing prejudice and clouding the o The report urged that the attorney general be petitioned to take charge of & new investigation of the slaying and that a judge from a disinterested district be assigned to preside. It also recommended legislation making it un- lawful for State’s attorneys to employ investigators on a “‘per buy” basis and that all investigators be made to qualify before a eircuit or coupty judge.
