24 REMARK T0 JUROR COSTS a0 FINE Virginian Reprimanded - at Second Trial of Dr. Reavis in Slaying. By the Associated Press. ORANGE, Va., September 8.—R. O. Halsey of Orange was fined $50 and ®everely reprimanded for comment- ing on the trial of Dr. George Reavis, jokingly, to one of the jurors just before the opening of the court here today. Halsey dmitted saying to one of the j “If you don't acquit that man you ought to be shot.” This was brought out in a hearing before Judge Browning, who informed Halsey that his remark was highly improper and discreditable and that the trial had been moved from Goochland County to Orange to avoid such occurrences. Counsel for both sides were appar- ently satisfied with the ruling and the trial continued. Mrs. Reavis, wife of the doctor, was called to the stand. She was pale and nervous as she took her seat. Defendant to Testify. Interest had been stimulated today in the second trial of Dr. Reavis, Goochland physician, for the killing of Gilbert Lacey, by the fact that the doctor regarded as the best witness for himself, was to take the stand and relate his account of the tragic night of March 2 before the jury. Should he convince the jury of the truthfulness of his story he would be able to batter down the wall of cir- cumstantial ‘evidence built up by the State since Monday. Dr. Reavis has contended that he fired blindly when a crowd of drunken men visited his home; that Lacey was among them and came within the line of fire; that he did not shoot with malice, but because he thought his home was threatened. This view of the slaying is in contradiction with the evidence for the Commonwealth, which is seeking to prove that Lacey was shot and killed when he alone visited the physician's home. ‘Ten Years First Verdict. 1In the first trial at Goochland Court- house the physician's version of the shooting was apparently not accepted by the jury and he received 10 years in the penitentiary for manslaughter. Now that the verdict has been set aside for incompetent testimony and 2 change of venue granted, the physi- cian will tell his story before a new Jury unacquainted with the case. The defense yesterday attempted to tear down the web of circumstantial evidence after the State had rested at noon. At the conclusion of the session the defense announced that Dr. Reavis and his wife, the only wit- nesses to the killing unless there were others with Lacey, would be the only two witnesses introduced today before the defense would close its case. ‘When Dr. Reavis completes his tes- timony for the defense today he will be given cross-examination by the State’s attorneys. At the completion of the cross-examination Attorney Stuart Robertson for the Common- wealth is expected to ask that the jury be taken, probably this after. noon or tomorrow, to the scene of thed killing in Goochland County. —_— WHIPPET RACES SET. The charge was lodged against Butler by Alice Fields, Fields’ mother. It is said that Butler arrested Fields August 18, on a charge of violating the prohibition law, and while taking him to the police station, struck him over the head with a revol Fields mained unconscious two days.
