Woodward Accuses Harvey of Swindling Him of $33,000. — s Oakland Office San Francisco Call, 1118 Broadway, June 13. Frank J. Woodward, a real estate agent of this city, says that he has been de- frauded out of $33,000 on a sale recently opsummated of the Sather tract by his private agent Teroy Harvey, and to this | end has begun suit in the Superior Court agalnst Harvey, Mrs. Josephine F. Bru- | gulere and W. H. Chickering to stop final payment of the money and save himseit ' the loss. | Acording to Woodward, who Is a m»m-! ber of the firm of Woodward & Watson, | he employed Harvey to conduct the ne- gotlations for him with Mrs. Brugulere | and her attorney, W. H. Chickering, for | | the purchase of the Sather tract. He' i claims that he has now found out that Harvey got an option on the property |and has made him pay '$33,000 more for | the land than the face of that option. | The money is now in the hands of At- ! torney Chickering and has not yet been transferred by him to the Bruguleres, ! and it is to stop Harvey from gaining this $33,000 more than the face of the option that the suit is brought. Mrs. Bruguiere | only interested in the suit indirectly, as | | she neither gains nor loses by its geci ston, and Mr. Chickering is only the cus- | todian of the money. The Sather tract is a finely situated | plece of property back of Lake Merritt, | on what was known as Indlan Gulch. Tt ! was formerly owned by Dr. Merritt and | ! Brugulere, and only recently a suit to| quiet title between the heirs of Dr. Mer- ritt and Brugulere was decided by Judge | Hall, It is valued at close to $500,000. ———— |NEW PALM 15 PLACED IN ’IHE PALACE HOTEL Plant Is Not as Tall as Its Predeces- | sor, but Considered More | Hardy.
