Tobey Assails F. C. C. Delay on Broadcast Monopoly Report Chairman Fly Expects Comnmittee to Have Draft Ready This Week The delay of the Federal Com- munications Commission in acting on the report based on the results of its investigation of alleged mo- nopoly in radio broadcasting was characterized as a “mockery” by Senator Tobey of New Hampshire. Senator Tobey has addressed identi- cal letters to each member of the commission asking the reasons for the delay. Chairman James Lawrence Fly of the commission said he expected that the committee of the commis- sion would have the report ready this week, but he was uncertain ‘whether it would be made public at the time it is presented to the full body. He asserted that the legal department was preparing a draft, and as soon as it is delivered he ex- pected the committee to consider it promptly. Report Rewritten Several Times. The report has been before the committee for several months. It was prepared by the staff and a representative of the legal depart- ment who acted as special counsel during the investigation. It has been rewritten several times. But it is understood now that it will be submitted to the commission on a factual basis, without recommenda- tions. Chairman Fly, although not & member of the committee, is the | only one who has been given a copy of the original draft. It is under- stood that this has been sent to the ‘White House, and as a result the report will not include amy recom- mendations for a crackdown on the broadcasting chains. Senator Tobey's letter said former Chairman Frank R. McNinch prom- ised the House Appropriations Com- mittee in November, 1938, that the monopoly report would be submitted to Congress within “60 days.” Mr. ‘Tobey declared that Commissioner Thad H. Brown, chairman of the Monopoly Committee, made a simi- lar statement in June, 1939, and Chairman Fly did likewise in No- ‘vember, 1939. Reasons Demanded. “It is now 18 months,” Senator Tobey wrote, “since Congress was officially told by the commission that its radio monopoly report and Trecommendations would be ‘ready in about 60 days.’ “I submit to you that, in the light of these facts, these assurances would seem to be a mockery.
