PITTSBURGH, June 4—The Gov- ernment asked yesterday dismissal of a preliminary injunction granted the Aluminum Co. of America restraining prosecution of an anti-trust STAR, WASHINGTON D. C, FRIDAY, against the company filed in the south- ern district of New York. Robert H. Jackson, Assistant Attor- ney General, and Walter L. Rice, spe- cial assistant to Attorney General Homer Cummings, made the request in a petition in Federal Court. The preliminary injunction was granted May 14 by Judge R. M. Gibson. The company contended that a suit | filed in Pittsburgh in 1912 was similar to the present anti-trust action and had Iifen terminated by a consent decree. The Government attorneys argued in their petition that all the company’s suit | records were not kept in Pittsburgh JUNE 4, 1937. and that the New York suit is not| identical with the 1912 suit.
