In denying the petition and order- ing a trial Justice Valente said that the answer of the Southern Pacific claimed the bonds in suit are owned by & New York corporation and that the coupons in suit were sold a few days before the date of their maturity | to the plaintiff to evade provisions of the joint resolution of Congress. “It is my opinion,” the court con- tinued, “that the defendant is entiiled to a trial of the issue of whether the transfer of the coupons to this plain- tiff was bona fide or with intent to evade the effects of the joint resolu- | tion as interpreted by the appeliate division.” £ .
