JAMES IS ACCUSED OF DROWNING TWO Previous Wife’s Death Cited in Trial for Murder of Seventh. By the Associated Press. LOS ANGELES, July 1.—Use of a previous wife's death as an additional weapon in the prosecultion of Robert 8. James on a charge of murdering his seventh mate was fought by his de- | fense attorney today. Prosecutors contend James drowned both women to collect their life in- surance—after other methods had failed, an automobile crash in one case, rattlesnake poison in the other, An argument on admissibility of testimony concerning the death of Winona James at Manitou, Colo., in 1932, was started yesterday when J. A. Rogers. superintendent of the Pike's Peak Highway, was placed on the stand. Scarcely had prosecutors begun questioning Rogers when the defense protested the case of Winona had nothing to do with the charge on trial—that he drowned Mary James last August after submitting her to snake bites. Deputy District Attorney Eugene ‘Williams told the court James struck Winona on the head with a hammer | - as they drove up Pike’s Peak, sent the car over a cliff as she lay unconscious, and reported it as an accident, in which he escaped injury The jury was excused while attor- neys argued the point. Superior | Judge Charles W. Fricke said he would rule on the question today. John Barnes, another deputy dh-‘ trict attorney, said Mrs. Winona James' body was found in a tub off water after she recovered from the supposed accident,” and that James received $14,000 in insurance. In a strategical about-face the de- fense announced James would testify next week, thus necessitating aban- donment of previous indications an insanity plea would be used.
