Mellon’s income tax hearing before the Board of Tax Appeals enters its third week Monday with the finan- cler's secsetary, Howard M. Johnson, prepared to undergo questioning about more of the transactions by which the Government charges Mellon evaded tax payments in 1931. It will be Johnson's ninth day on the witness stand. He will face sev- eral hours of re-direct examination by Frank J. Hogan, chief Mellon attor- ney, before being turned over once more to the searching questioning of Government attorneys. Counsel for both expressed satisfac- tion with the progress of the case, in which Mellon contend$ *he has a re- fund of $139,000 coming from the Bureau of Internal Revenue, while the Government is trying to collect $3,089,000. Hogan said Mellon will not dodge responsibility for his 1931 income tax report—which Johnson has testified he alone prepared and Mellon did not closely scrutinize. In fact, Johnson said Mellon's signature was not no- tarized at the time. Hogan, upon resumption of the hearing, is expected to take up some of Mellon’s business connections, to show that he did not control the Pittsburgh Coal Co., the Union Trust Co., his children's Coalesced Holding Co., Coalesced’s Smithfield Securities Co., and Mrs. Ailsa Bruce's Ascalot Co,, also a holding concern. The Gov- ernment charges Mellon used these concerns to make transfers of stocks and securities, in order to deduct losses on his income tax returns. Unemployment Declines.
