By the Associated Press. NEW YORK, April 18.—The appellate division of the Supreme Court today upheld the right of Judge George Smyth of the Westchester County Children's Court to order an operaticn performed on 2-year-old Helen Vasco, who has been spirited away from her home at Hastings by her parents. Helen Vasco'Is suffering from a ma- lignant tumor in her left eye which doctors belleve will cause her death unless it is removed, although the op- eration would cost the sight ¢f that eye. The parents, recent immigrants, re- | tused to permit the operation and agents of the Children's Society took the mat- ter to Judge Smyth. He ordered the operation, but stayed his own; order pending ruling on it by the appellate division. % Twin Sister Fell Tl While the higher court was consider- ing the matter Helen's twin sister fell ill and the parents barricaded their home against every one, including doc- tors and police. The case aroused so much interest that crowds congregated about the| home in the Hudson River town and | were only kept at a distance by threats f the Vascos to pour bolling water on any one who approached. Last Saturday the whole family sud- denly disappeared and police sought them in New York, New Jersey and Pennsylvania. Yesterday the father, John Vasco, ap| Eennd at a police sta- tion and said his family had been vis- iting relatives and would return home today if protection from invasion of their privacy by the curious could be guaranteed. Police promised. to: rope cfl the street and guard the house. Prompt Action Is Urged. The illness of the second child, Anna, proved to be of no seriousness, but Helen's infliction is one which doc- tors called into the case by the Chil- dren’s Court believe calls for prompt operative intervention. ‘The father, even before he took his family away, had become reconciled to the prospect of an operation if the courts should decide it was necessary, but he said his wife was still firmly set against it. If a toga were draped around the ample form and a band tled around the benign head of William H. Dieterich’ of Beardstown, I, he would be the counterpart of a Roman Senatar. Instead, he is the new American Sena- tor from the State that has produced Senator James Hamilton Lewis and Speaker Rainey. Mr. Dieterich, who began his political career as a representative in the fiftieth and fifty-first general assemblies of the State of Illinois, and was elected to the Seventy-second Congress as Representa- tive at large, is concentrating on carrying out the program of the ad- ministration. His profession is law and he is one to give any legislative problem plenty of study before he commits him- self.* ‘Neither in the Senate chamber nor outside does he hazard an opinion on any current measure. He gives the impression of being a - conservative Democrat who would follow the estab- lished principles of the party and not be sidetracked by any radical or even liberal suggestions. Simpleness of Campaign. ‘Though the intracies of Illinois State politics demand the understanding of a calculus expert, the Senator’s cam- paign seems to have been carried on with - reasonable simplicity. In the primaries he had a plurality of 216,043 votes over the seven other candidates, six of whom came from the neighbor- hood of Chicago. The Democratic or- ganization, headed by ex-Mayor Cermak, decided to support Mr. Dieterich and the machine rode unobstructed to vie- tory, defeating the Republican Senator, Otis F. Glenn. Senator Dietrich was born in Coop- erstown, Brown County. He went to & bustness college in Rushville, Ill., and then studied law at the Northern In- diana Law School in Valparaiso, Ind. He hung out his shingle in Rushville and became in turn the city attorney, treasurer of the Rushville Union Schools, master in chancery of Schuyler County and county judge of the same county. From 1913 to 1917 he was spe- clal inheritance tax attorney and after that he went into the State Legislature. Prefers Agrarian Life. Although he had a good offer to join a law firm in Chicago, he preferred the agrarian life and made his home in Beardstown. Beardstown is noted for its melon crop and its propensity to ab- sorb water from the Illinois River when- ever it floods. The melons prosper on this sand-covered soil and there is a Wednesday Only 4 PM—8 PM. Totally undismayed by threats of nepotism, he made his daughter one of his two sec- retaries. She is continuing now that he is in the Senate and manages to be both efficient and charming. Senator Dieterich is a member of the Benate Committees on .Interstate Com- merce, Naval Affairs and Civil Service. His hobby is historical research and his daughter describes lcg motor ‘tours to famous places. “I am poor material for newspapers,” the Senator said, and he is very cau- tious about personal publicity.
