RADIO COMMISSION POWER TO BE TESTED ‘Whether the Federal Radio Commis- #ion has absolute powers or merely the discretionary authority of a minor bu- reau in parceling out radio station fa- cilities will b> decided by the Supreme Court of the United States shortly in the most imporiant radio test case ever to be appealed. On peiiticn of the Department of Justice, acting for the commission, the court this week granted & review of the celebrated cece involving Stations WIBO and WPCC, Chicago, which were or- dered off the air by the commission to make way for-=@tation WJKS, Gary. Ind. The commission's decision bued on the =co-called Davis equalization amendment to the radio law, was re- versed by the Court of Appeals of the District of Columbia. It is from that ruling that the Government aj led. While only three stations are involved in the proceeding, the decision actually affects practically all American sta- tions. Final adjudication in the com- mission’s favor would mean that it would arbitrarily lop off stations in the 27 States which are overquota in radio facilities under the commission’s quou calculations worked out according population of the respective amu Conversely, it would be empowered to assign additional facilities at will to underquota States by taking lhm away from overquota States—all this to be done regardless of investments, property rights or public service of the stations in_the overquota areas. ‘The commission’s decision was based g: the fact that Indiana is 32 per cent derquota, while Illinois. is 585 cent overquota. The court held the commission’s action was “arbitrary and capricious,” and that Gary actually is a suburb of Chicago and gets service from Chicago stations. WIBO and WPCG operate jointly on the cholce frequency of 560 kilocycles. ‘WJKS shares time with a Chicago sta- tion, on the less desirable 1,360 kilocycles, and seeks the length of its Chicago rivals.
