BY JOHN F. MILLER. Whether a filling station is & chain store is a question that today is giving some concern to the oil ocompanies. The matter came up in Indiana imme- diately after the decision of the Su- reme Court of the Unitde States hold- ?n' the chain store tax law of that State to be valid. Under the Indiana statute all related stores in the State in excess of 20 must pay a license tax of $25. This means, of ‘course, that if the filling stations are chain stores, the larger companies will have to pay such a tax for the large majority of their stations. 1t means something more than that, tax experts pointed out today. There is nothing in the opinion restricting the amount of the levy which may be im- poud upon the chains, so long as their perty is mnot actually confiscated, and ntumpu to impose a tax of $100 have been made in two States wlt.hln the past few days. Liability in Doubt. In Indiana the liabllity of the filling stations has not yet been decided. The chairman of the State Board of Tax Commissioners says that he sees nothing in the law to exempt them, and he has asked the State attorney general for an opinion, which will undoubtedly be followed unless overruled by the courts. The Wisconsin attorney general's office has already ruled adversely to the stations in connection with a bill pending in the Legislature of that State. In 1929 the Standard Oil Co. had gross sales in Wisconsin of $28,599,724, gross profits of $8432,650, and taxable net income of $1,406,313. The Atlantic & Pacific had gross sales of 322,871,826, gross profits of $3,939,338, and net tax- Ihla income of $499.716. Why should the Atlantic & Pacific be subjected to the chain store tax and the Standard Ofl excepted, the Wisconsin attorney general asks. In North Carolina service stations are not subject to the chain store tax, but pay a special license tax of their own. ‘While most of the State Legislatures have adjourned for this year, chain store tax biils are still rndml in Ohio, Illinols, Wisconsin and Florida. Two years from now 44 of the State latures will again be in session and a flood of chain store legislation may be expected, unless something happens in the meantime to change the situation. Petition for Rehearing. Every effort is being made by the ehains to see that something does hap- pen. A petition for rehearing is being filed in the .Indiana case, and that may tie up the enforcement of the act until next Fall. Two cases are still before the Supreme Court, and that court will be asked to reverse its decision, or to limit it in such a way that no tax of imposing proportions may be levied. OTTAWA, June 2 (#.—Production of silver in Canada amounted to 1,886,652 ounces in March, 10.7 per cent less than February, but 40 per cent above March, 1930, the Dominion Bureau of Statistics announced today. Gold output in° March aggregated 203,813 ounces, against 195,118 ounces in February and 163,771 ounces in March, 1930. . Nickel output in March amounted to #938,358,289 pounds, making the total for the first quarter 21,552,418 pounds.
