B—16 SCHUMANNAEN ASKS NEW HEARNG Son of Noted Singer, Denied Appeal on Stock Theft Con- viction, on Probation. Br the Associated Press LOS ANGELES, June 19.—Henry Schumann-Heink, son of Mme. Ernes- tine Schumann-Heink, filed' a petition with the State Supreme Court yester- day for a rehearing of his rejected ap- | peal from a conviction for grand theft. Schumann-Heink, former président of Schumann-Heink & Co., a stock and bond corporation with offices in Los An- geles and other cities, was convicted of depositing 12 shares of the company's stock as collateral for a personal note. The stock was alleged to be the com- pany’s property. Wilfred M. Clare, secretary and treas- urer of the company, deposited the stock August 25, 1927, with the bank holding the note. He testified he complied with Schumann-Heink's instructions. Schumann-Heink, convicted in Oc- tober, 1928, obtained a reversal, but was again convicted. A new trial was de- nied and he was placed on five years' probation. The District Court of Ap- peals denied his appeal. The appellant claimed Clare deposited the stock on his own initiative and without authorization. STUDENTS FIGHT FIRE IMPERILING CROWD Speaker Longworth and Secretary of War Hurley Had Just Left Pennsylvania College. By the Associated Press. CHESTER. Pa. June 19.—Possible tragedy at the commencement exercises of the Pennsylvania Military College yesterday was averted by the coolness of student cadets, when fire swept through 100 feet of wooden storehouses under the stadium. Several thousand persons were in the stands, when smoke began seeping up through the concrete and brick stadium. ‘The cadets were going through the gar- rison drill closing the exercises and the guests who received honorary degrees, including Secretary of War Patrick J. Hurley and Nicholas Longworth, Speak- er of the House of Representatives, had Just left the stadium. As soon as the extent of the blaze became apparent, cadets not in the parade, and policemen quietly marshaled the crowd to the various exits, while the bands continued to play and the drill went on in the field.
