John R. Buchanan, son of the late Gen, James A. Buchanan of Warren- ton, Va. today asked the District Su- preme Court to dismiss the suit for sep- arate maintenance recently filed against him by his wife, Ruth L. Buchanan, daughter of Wharton E. Lester, local attorney. Mrs, Buchanan complained that her husband had ceased payments of her allowance of $12,000 annually since last November, but did allow her $500 monthly until’ February 1, when she charges, he deserted her and has not since contributed to her support. Buchanan is one of three heirs of the $4.000,000 estate of Gen. Buchanan. ‘The. husband charges that his wife has a_“vile and viclous temper.” She has threatened to commit suicide on many occasions, the husband avers, and on February 2 in a fit of temper un- dertook to kill him by leveling a loaded pistol at him and pulling the trigger. Except for her ignorance in connection with the loading of a pistol and except for the fact that the trigger fell against empty chambers instead of chambers in which cartridges had been placed, the husband asserts that the “probabil- ity is that the said plaintiff would have shot and killed this defendant.” The wife is also accused of extrav- agance by the husband. ‘The husband also objects to the wife having the exclusive custody of their three children, which she has had since February, and asserts that it is impos- sible for him to visit the children at their home since he has been informed that his wife has purchased another pistol, he having hidden the other pistol from her. He says he is entitled to share the custody of his cildren and to visit them without interference or molestation from the plaintiff, and the court is asked to make such order. Attorneys Minor, Gatley & Drury represent the husband, while the wife is represented by Attorneys Wilton J. Lambert and Rudolph H. Yeatman. Justice Wheat today continued for two weeks the hearing on the wife’s motion for temporary alimony.
