SAN FRANCISCO, June 6.— The Government has lost its first test case In a drive against restaurant and cafe owners who serve “set-ups” of ice and ger ale to guests with the knowl- | edge that they are to be used in mix-| ing intoxicating drinks. i Federal Judge Kerrigan yesterday directed s verdict for Edward Spohn, Mmanager of the Silver Slipper Cafe. after pointing out there was a “fatal variance” between the wording of the complaint on which his place was raid- ed several weeks ago and the evidence presented by prohibition agents during the trial. | Defense Scores Point. H Defense attorneys elicited the admis- | sion from a Federal under-cover agent that he had visited the cafe with an- other man and two woman friends and had drunk liquor purchased earlier in the day from a bootlegger as evidence case. This evidence, the agent admitted, was consumed during their evening at the cafe. ‘When the Government failed to ve that Spohn kept “certain liquors or sale” as was charged in the com-! laint, the directed verdict was made y Judge Kerrigan. Testimony indi- | cated all liquors seized in the raid be- | longed to patrons.
