LABOR'S PLAUDITS WON BY HUGHES Dpinion cn ‘Company Unions’ | Explodes ‘Human Rights’ Criticism in Senate. | BY FREDERIC WILLIAM WILE. When Chief Justice Charles Evans Hughes takes ship next week for his Bnnual vacation in Europe, there will still be ringing in his ears the plaudits of American organized labor. Unbe- known to the country at large, the man * who was under heavy fire in the Senate four months ago as the champion of | * rights” against “human | rights” has, in his first major decision, | knocked the pins from under that charge. On May 26, the Supreme Court, by unanimous vote, sustained the Railway Brotherhoods' contention that railway companies have no right to_interfere | with workers' organizations. The opin- fon was written and read by Chief Jus- tice Hughes. It involved, to a consider- able extent, the' self-same principle which proved the undoing of Judge Parker of North Carolina in connection with the now celebrated “Yellow Dog” miners’ contract. The Supreme Court, ! concurring _without dissent in Chief Justice Hughes' opinion, decided for the raflway men and against the railway| operators. | * “The effect of the verdict is that no | *“eompany union—i. e., a union consist- ing exclusively of men employed on one | single line—can be legally maintained prise to the brotherhicod's counsel. They had made a minute survey of Hughes’ decisions in previous litigation involving kindred issues, The survey induced the rallwaymen's lawyers to figure that there would be at least four out of tht votes in their favor. The luded, according to their Stone. decree in favor of the workers turned out to be Unanimous was an agreeable surprise. By good luck the brotherhood's prin- cipal counsel, Donald C. Richberg of Chicago, who argued the case, ed 1o be in the Supreme Court room when the Hughes decision was handed down. He particularly rejoicés. that the court nalls to the mast the principle that collective action “would be a mockery if representation were- made futile by |. interferences with freedom of choice.” (Copyright, 1930.) They’re f ganization. The railway brotherhoods have been fighting “company unionism” | for years. Some 50 lines throughout the ‘country have ‘‘company unions,’ the one within the Pennsylvania Rail- | road system being probably the out- standing example. The purpose of *“eompany unions,” of course, is to en- able the rail operators to bargain, on controversial occasions, with their own employs only, instead of having to deal with them through the brotherhoods. | Case Brought by Clerks. | The case just decided concerned the | attempt of the Southern Pacific lines in Texas and Louisiana to maintain the principle of “company unionism.” It was appealed to the United States Bupreme Court, after the Southern Pa- cific had been defeated in both the FPederal District Court of Texas and in the Federal Court of Appeals sitting at New Orleans. The case was brought by the Brotherhood of Railway Clerks. | In the first trial before the Federai Court at Houston, Judge Hutcheson ordered the Southern Pacific to dis- band its “company union” and to deal with the brotherhood until the road's clerical employes, by a secret ballot, themselves decided otherwise.
