BISMARCK, Dak, May 8.—The State Supreme Court, by & 3-to-2 vote, yesterday upheld the statute providing life imprisonment for a fourth convie- tion of felony. The decision was on the case of Joe Malusky, convicted of pro- hibition law violation, which had been appealed. The court held that violations of the prohibition law constitute moral turpi- tude and therefore come within the provisions of the habitual eriminal act. The court divided three to two in the decision. The majority opinion held that “moral turpitude is evidenced by an act of baseness, vileness or depravity in pri- vate and social duties which man owes to his fellow man or to melet{‘ in gen- eral” and that “violation of the prohi- bition law as a second offense involves ‘moral turpitude.” Malusky, who admitted two previous convictions for felonies in other States, been sentenced to four years' ime prisonment.
