Hobley in Rockville, where he was charged ‘with assault, the girl instituted suit for $1,000 through her grandmother, Mrs. Margaret V. James of 1360 East Capitol street. Testimony given before the court was %o the effect that the girl, accompanied by her 10-year-old sister and another 1, went to the major's home on Hal- veen night. Hobley's daughter Dor- othy, a friend of Margaret’s, was seated near the window and tue children at- tempted to attract her attention by throwing peas against the windows. ‘The major, it was said, rushed from the house to disperse the group, be- | lleving they were merely playing a| Halloween prank, and was carrying a cane. Margaret, it was said, was clad | in boys' clothes, and when she ran | the major followed her. Margaget said she stumbled and fell | and while prostrate Maj. Hobley struck | her with the cane. The jury was advised by the girl's| parents that when she returned home | Halloween night she had twp marks on her body and was unable to sleep for several nights. Maj. Hobley said the girl did not stumble, but threw herself to the ground and was bruised. He denied striking the child and said the jury find- ing was “unjust.” .
