20 REAL ESTATE. ‘THE EVENING STAR, WASHINGTON D. C., SATURDAY, FEBRUARY 16, LN BL IS HED HEL T0 DWNERS Enactment Would Be Step for| Free Sale of Property, Says Realty Board. A bill providing for the divestiture of | Federal liens has passed the House of Representatives and is now in the hands of the Senate committee on the | Judiciary. “The bill is of importance to all| owners of real estate in that its enact- ment would be a definite step toward the removal of unnecessary restrictions | #gainst the free sale of real property.” the National Association of Real Estate Boards declares. | “The enactment of this bill, H. R. _ noweor wiwww.mauiav | |ILLION IS ASKED 13981, would permit the United States | to be made a party defendant in cases | in which a mortgagee seeks to foreclose | under his prior lien where there has been filed against the real estate a junior lien by the Federal Government | for some debt due the United States by | the owner of the equity in the property | and for which the mortgagee owes no obligation,” the board said. | Effect Is Cited. The effect of the bill on real estate | liens as stated by the House committee n reporting on the bill g its passage is as fol- “This legislation has been recom- | mended * * * in order to relieve | against the injustice with which mort- gages are confronted under the present stat of the law who find, when it is necessary to foreclose their mortgages, that there has been filed against the property a junior lien by the Federal Government for some debt due the United States by the owner of the prop- erty, and for which the mortgagee owes no obligation either legal or moral. The essence of the bill as outlined in | the report of the House committee on | the judiciary is as follows: “The bill simply provides that when- ever a prior lien or encumbrance bill shall have been proceeded upon in a State court, and it shall appear that there Is filed of record a lien in favor of the United States * * * the plain- | i or plaintiffis * * * may have the proceedings removed to the United States district court in the district where the property subject to the lien is situated and authorizes the district court to enter an order expressly author- izing the addition of the United States as a party defendant and to proceed to a hearing upon the question of the priority of the lien of the plaintiff or plaintiffs over the lien held by the United States. After determination of the status of the Federal Government's lien * * ¢ the case shall be remand- ed to the State court * * * so that it may proceed to execution and to sale, subject, however, to such order as may be entered by the United States district court, limiting the judgment in the suit os against the rights, if any, of the United States. “The bill further provides that the llen of the United States upon the prop- erty in question shall be subject to dis- charge from sald property by the judicial sale ordered by the State court in the same manner as may be provided by the State law as to other liens and that the United States shall be rele- gated to the fund produced by such sale. * * * The procedure provided aliows the State court to retain its juris- dicuion over the real estate, saving only to the Federal Government the right to | determine the status of its lien In its| own court. “It is hoped that Congress will speed- 1ly enact this legislation.” English-type residence at 3211 Idaho avenue, Cleveland Park, which has been purchased by Mr. Hallam, vice president of the District Lawyers & Wash- Hedges & Middleton, Ine. | ington Title Insurance Co. NAIROBI, East Africa (#).—A series of murders has thrown one part of Kenya Colony into disorder. They are believed to have arisen out of the old native supersition that the young war- rior cannot enter manhood until he has “bloodied his spear.” The killings followed a celebration of religious rites of young men of the Masai tribe. Disturbances usually arise after these observances, and the recent one was the largest in the history of this tribe. The situation is serious enough to induce the governor to proclaim a cer- tain area of Masal province “a dis- turbed area.” and to send in additional police forces. Something for Nothing! A broken leg and face lacerations, at- tributed by police to a leap from a sec- ond-story window during domestic trouble, sent Rebecca Ross, colored, 37 years old, 744 Sixth street southeast, to Casualty Hospital early today. Fifth precinct officers, investigating, were told Mrs. Ross made the jump when she became frightened TORECLAIM ALAMO Texans Want Site of Famed Battle Restored and Preserved. By the Associated Press. SAN ANTONIO, Tex.—Paved streets and plazas, stores and towering busi- ness buildings surround the Alamo, the “:hcrmonyh: of the Western Hemis- ere.” Commercial demands have encroached on the Alamo until nothing but the church and a portion of the walls re- main. The church now houses a col- ;efléon of historical documents and ob- jects. A bill before the State Legislature proposed a $1,000,000 appropriation to recover as much of the old tract as possible. ‘The Alamo's defenders in the war for Texas independence died to a man rather than surrender, and their brave sacrifice is like that of the 300 Spartans under Leonidas, who gave their lives defending the mountain pass through which the Persians had to go before they could invade Greece. Bullet Marks Show. ‘The stonework around the door of that part of the Alamo which still | stands is deeply pitted with bullet marks made by Santa Anna’s Mexican soldiers as they stormed the garrison. The building was originally the church of the Mission San Antonio de Valero. The mission itself included land on all sides of the church. The first stone of the church was laid and blessed by Spanish priests in 1744, but some of the buildings antedated the chapel. ‘The battle of the Alamo was the outstanding engagement in the war for Texas independence. Santa Anna, de- feated, had returned to Mexico for an army of 5000. Meantime there was dissension among the Texans as to whether independence or justice under Mexiean rule was most desirable. Travis assembled his men and, de- claring he never would surrender, drew a line in front of him and requested all who would stay with him to step across the mark. All but one walked across the line. The exception was Col. James Bowle, who, because of illness with pneumonta, ordered the soldiers to carry him across, and he fought until all his ammunition was exhausted. After a 13-day slege the Mexicans broke into the fort March 6, 1836. They slew every defender. No man knows where the ashes of the defenders rest. Santa Anna had the bodies burned on two great pyres. When Texans recaptured the town, they buried the remains, but the exact spot is not known. A tablet has been erected on the approximate location. —_—— Rabbi Harold F.
