NEW YORK, December 17.—One of the nurses who attended Arnold Roth- stein after he was fatally shot testified today that Assemblyman Maurice Can- tor, the gambler's lawyer, directed Roth- | | stein’s hand in making his mark on & will that made Cantor one of the chief beneficiaries. ‘The nurse, Miss Elizabeth F. Love, said that Cantor placed 2 pen in Roth- stein’s hand and then wiggled it so that | i a mark was made in the space for the gambler’s signature. ‘Mr. Canton,” she said, “told us not to tell what went on in the sickroom.” Miss Love, one of two nurses whose names appear on the will as witnesses, gave her testimony before an official surrogate's stenographer in contest pro- ceedings brought by Rothstein’s rela- tives. Nothing Lett to Parent. The will being contested leaves nothing to Rothstein's parents and re- duces the amount bequeathed in a for- mer will to the widow in order to leave an interest in one-sixth of the estate to Inez Norton, a show girl. The con- tested will leaves practically the entire estate, believed to be worth about $1,- 800,000, to Cantor .and two other ex- ecutors after the termination of va- rious trust funds. Under questioning by Cantor’s attor- ney Miss Love described the deathbed scene in detail. “Cantor said,” she testified “‘Arnold, this is your will’ Rothstein’s eyes were closed at this time, and after explaining over and over again to Rothstein, Roth- stein said in a very weak voice, ‘Will." Then Cantor said, ‘This is your will, Arnold. I made it this morning just as you told me. Put a Pen in His Hand. The nurse said Cantor then gll pen in Rothstein’s hand, and ‘It just stayed there, very languid.” “Then Cantor [ot hold of the hand,” she continued. “and wiggled it and made the mark.” “Did Mr. Cantor say anything to you at the time?” the assemblyman's law- yer asked. “He told us not to tell lnythlnl that went on in the sickroom.” ‘The lawyer had his objection to this answer noted in the stenographic re- port, which will be presented to Sur- rogate John P. O'Brien for his consid- eration. COLORED MAN 1S HELD ON CHARGE OF MURDER Accused of Shooting His Guest as Result of Dispute Over . Card Game. - A charge of murder was preferred against ‘John Henry Day, colored, 37 years old, of 643 Morton street, follow- ing the death early yesterday morning of Harry Smith, also colored, 40 years old, of 432 Neal place. Police were told the men engaj a dispute over a card game, and it u Smith was taken to Freedmen's Hos- pital by police of the tenth precinct and pronounced dead. Policeman Bu- chanan arrested Day and held him to await & coroner’s inquest at the morgue today.
