28 $389.833 REFUND PAID 0 COUZENS Receipt of Check Ends In- come Tax Dispute Based on Ford Motor Stock. @y the Associated Press. The Treasury's attempt to obtain an additional $10,000,000 income tax pay- ment from Senator Couzens, Republican, ‘Michigan, ended yesterday with the re- ceipt by the Senator of a check for $989,833 from the Government as a refund on his income tax. The refund payment ended a bitterly fought contest between the Govern- ment and the original holders of Ford Motor Co. stock, including Senator Couzens, which started almost four years ago, simultaneously with the pub- iic dispute waged by Secretary Mellon and the Senator over administration of tax matters. Whether that dispute between the Republican leaders which started over the merits of a contention by the Treas- ury head on tax reductions is ended by the termination of the court contest was not clear tonight. Senator Couz- ens still has before the Senate a reso- lution asking for the resignation of Mr. Mellon for maladministration. Sena- tor La Follette, Republican, Wisconsin, also has a resolution asking an inquiry of the Government tax suit against Senator Couzens. Treasury Silent. Treasury officials were silent yester- day on the entire case, word of the re- fund coming from outside sources. It was confirmed by Senator Couzens, whose son collected the Government's check today in Detroit. “This is a concrete piece of evidence,” the Senator said in confirming the re- fund, “of the mismanagement of the Bureau of Internal Revenue under the test Secretary of the Treasury since Alexander Hamilton’s time.” “If Congress is able to compute the entire losses to the Government under such management,” he declared, “it will be found to have run into the hundreds of thousands. It is this power in the Treasury Department to punish any one who disagrees with them which has in- timidated thousands of taxpayers who otherwise would feel free to criticize.” Charges of Government. The Government charged the Ford stockholders had overvalued the orig- inal worth of their stock in computing their profits on sales in 1919, on which taxes were paid in 1920. Five years later, just a few days before the statue of limitations had run, the Government instituted suit for collection of $33,000,- 000 additional tax from the stockhold- ers. This was just at the time Mr. Mel- Jon and the Senator were quarreling, The case was lost by the Government both in the Federal Court and before the Board of Tax Appeals. The board held that in place of the additional as- .sessment _the stockholders were entitled o the refund. Rust of 12315 Bancroft place yesterday were named defendants in a suit for $50,000 filed in the District Supreme Court by George A. Casey of 1736 Bay street southeast. Through Attorneys Ring and Cobb the plaintiff alleges that he ‘was unlawfully arrested on May 11 and 1d under .bond until May 16, and that e defendants refused on two occa- sions to go into Police Court and testify against him after instigating his arrest.
