SYEARDLD “MUTE SPEAKSINCORT Mother of Boy Principal in Damage Suit Held as Perjurer. By the Associated Press. NEW YORK, November 9.—Mrs. Anna, Friedman was'in jail today because her “mute” 5-year-old boy talked. She sued R. H. Macy & Co. for $50,000, al- leging that one of the department store's trucks struck her son and took away his power of speech. ’ During trial of the case a court at- tendant asked Hyman Friedman which of two other small boys had pinched him in the hall. “He did,” said Hy- man, pointing. The court attendant talked to the judge. The judge talked to Mrs. Fried~ man. She was held in lieu of $10,000 bail pn a charge of perjury and con- spiracy. “It is the most outrageous case of attempted fraud I have ever seen,” Su- preme Court Justice Gibbs said. Mrs. Friedman had testified that Hyman had not spoken since the accident, which occurred October 13, 1923, when her son was 7 months old. The woman averred that the truck had run on a sidewalk, upsetting the carriage in which Hyman was lying. ‘The company gave her $2,500 for her own injuries, but refused to pay $25,000 for the alleged injuries to the baby. ‘The company offered $12,500, but she refused it. Seven reputable physicians examined the boy. but could not make him talk. ‘The judge himself talked to Hyman for 45 minutes in his chambers, but could draw no syllable from him. JEWEL BROKER ROBBED. By the Associated Press. NEW YORK, November 9.—The Civil Liberties Union, which was active in the defense of John T. Scopes in the Ten- nessee evolution trial, announced that it is looking for another school teacher in Arkansas, Mississippi or Tennessee will- ing to file a test case to bring the issue of State anti-evolution laws before the United States Supreme Court. ‘The union said that the occasion for this search is “the persistence of fun- damentalists in their campaign to put such laws on State statute books.” Only Tennessee, Mississippi and, by the elec- tion just completed, Arkansas, now have such laws, but the union said plans are being made to urge them on many Legislatures meeting in January. The union asserted that a case such as it proposes would not be “another drama of international notoriety” like the Scopes case. = A More than 140,000 cattle were killed in Rio Grande du Sol, Brazil, this sea- son to be converted into frozen beef.
