A motion was filed in Federal District Court to dismiss the original complaint brought against the railroad a year ago charging violation of the Federal stat- ute in the alleged fostering of a com-. pany union of clerks in opposition to the Brotherhood of Railway Clerks, rec- ognized by the United States Railway Labor Board as the representative labor organization. The raflroad’s answer denied that the brotherhood represented a majority of the clerks, and also denied that its offi- clals had “inspired and instigated” for- mation of the Employes’ Assoclation, de- clared by the brotherhood to be domi- nated by the company.
