LEITER IS TERMED STEADY FAILURE Countess’ Attorney Flings Characterization During Cross-Examination. By the Assoclated Press. CHICAGO, December 9.—Joseph Leiter, one of the heirs of the vast estate of his father, Levi Z. Leiter, ploneer merchant prince of Chicago, heard himself termed yesterday “a failure in every enterprise he has un- dertaken.” The characterjzation was by Frank H. Scott, Chicago, attorney for the Countess of Suffolk and Berks, the former Daisy Leiter, who through a protracted law suit has sought to oust Joseph Leiter as a co-trustee of the Leiter estate. Details Are Examined. Cross-examination of Leiter dropped to detalls of a minor deal in real estate after it had dealt with property valued into the hundreds of thou- sands of dollars. Judge Dennis Sulli- van questioned the relevancy of the questioning. “We want to show that this man had been a failure in every enterprisc he has undertaken,” explained Scott, “and been saved from his folly only by the phenomenal increase in the value of Loop (downtown Chicago! real estate that is part of the estate: Court Shifts Quiz. “Well,” countered the court, “if ‘we are golng into the details of every enterprise in which Mr. Leiter has been involved we will be here four years from Christmas.
