Everything is up and coming, trade xrows better «very. day,. mills and factories are humming, all- the .folks are making hay. Punktown boasts her boom and flaunts it,-she enjoys 4 gorgeous time; every man has the wages are sublime. People wha were lately busted, profiting from lessons stern, surely now may well be trusted to put kopecks in an urn. They have known want's bitter meaning, heard the landlord’s hymn of hate; they ‘have seen the bailiff leaning, with his summons, on the gate. Two members of the Federal Trade Commission, Thompson and Nugent, revealed today their objection to a majority decision refusing to give the Attorney General access to files and records which had been voluntarily de- livered to it during an investigation, without the “express consent’ of the respondent involved. The ruling which was effective January 16 and has been followed in a number of cases, was held by the dissenting com- missioners to be against the public in- terest, not warranted by any provision of the Federal Trade Commission act, and tended to hinder, delay, and de- feat the ends of justice. The rule was established when a ma- Jority of the commission voted not to glve the then Attorney General Stone access to certain records concerning the Aluminum Co. of America in which Secretary Mellon was a stock- holder. The records were given to the D. 0, FRIDAY, NOVEMBER 27, 1925. commission during the inquiry of household furnishings industries asked by the Senate. The Aluminum Co. was charged in the commission’s port with holdlng a “monopolistic position” and with having “apparent!: engaged in various practices forbidden by ‘a judicial decree under the -Sher- man act.” The dissenting opinion quotes one of the majority members of the commis- sion.as saying in a speech at St. Louls that the ruling was adopted to let the “business men of the country know that when we usk them for informa- tion, such information is for usalone,” and “we want them to understand that thereafter the Federal Trade Com- mission 18 not going to be & sort of smelling committee or a detective agency for any other department of the Government.” ~ Their objection; to the ruling, the dissentegs declared, was that it gives, in largé measure, immunity from prosecation to, and makes of the com- mission a place of sanctuary, a haven of refuge for, every company, corpora- tion and assoclation in ihe country which violates sections 1, 2 and 3 of the Sherman act and, when investi- gated by the commission, delivers to it all incriminating evidence in its Licked at the Start. ‘ } From the Los Angeles Times. A negro was up in Santa Ana police court as a witness before the late Judge Cox, whose name was more or less of a terror to the uninitiated. “Sam,” sald the judge gravely, “do you swear to tell the truth, the whole truth and nothing but the truth?” “Yassir, if you all insists.” “Very well, Sam.
