ABOVE SUSPICION By Robert Orr Chipperfield. Author of “The Second Bulles,” “Unseen Hands,” “The Trigger of Conscience,” Ete. Copyright, 1023, by Robert M. McBride & Co. (Continued from Yesterday’s Star.) “When first went home I was nearly crazy, tor 1 saw that if I didn't act quickly it would mean the end between Miss Mildred and me they would take her away and *ust heaven knows what sort of persua- sfon to force her into marriage with Lane. She is staunch and high- spirited but only a little slip of a girl, defeuseless in_their bands, and 1 knew Benkard;.I knew that nothing had ever stood in his path. The more 1 thought the more desperate 1 grew, and only one idea came to me; wWe would have to elope. I got out my motor boat, and though something was wrong with her lights I ran her to the place where Sim Perkins saw | me go ashore, and crept up the rear path and across the lawn till I stood under Miss Mildred's window. “It was darl, however, and so was 21l that side of the house, and 1 didn't dare risk trying to arouse her without waking up the rest. cided to wait till morning and then FeL 8 message to her somehow. so started back down the path, when all at once I saw the lights in the patio and Benkard sitting there on the bench just inside the doors. A sudden Impulse came to me to gO and have it out with him, tell him once and for all just what'I thought of him as no man had ever dared tell him before and defy him to keep Miss Mildred from me! | was almost out of my head with jealousy and resentment or I never would have dreamed of such a fcolish move, of course, while Miss Mildred was still there 'under that roof. but 1 had almost reached the top of the terrace £teps before I came to my sense Benkard hadn't discovered me, only the hand holding his clgar moved and the last I saw of him was with a wreath of tobacco smoke curling straight\up above his head, as I turned and went down the steps again to the shore.” Pupert broke ., and then added with a groa Tm not thinking so much of m self, Geo: people aren’t convicted of murder on such circumstantial evidence as that in very many cases, but the disgrace of the trial alone be, especially if they never find out | would about kill my mother and ruin father, and there is Miss Mildred! She would be alone for weeks, per- haps months. under the influenice of her mother and Lane, and although 1 know she'd stick to me, her shame @nd suffering under their taunts would be horrible! I might be con- victed in the second degree and sent to prison for vears, for life, but even 1f I were acquitted I couldn’t ask her to share such a future as mine would who really killed Benkard. You know I didn't do it; if T thought you doubted me for a minute I wouldn't be sitting here, but in God's name can vou help me? There was silence in the little kitch. en for a_long time after the boy's appeal. Geoff sat lost in reflection, his plain, rugged face growing more grave as each moment passed, and when he spoke at last his voice was deep with solemnity. es, I know you didn’t do it, Mr. Ashe, and I kin help vou; reckon I'm | ‘bout the only one who could. This is what comes o' not mindin' my own business, or mebbe it's the Lord's doin’' all the way through: mebbe vou was sent to me. I can't stop Your bein' took up. and there ain’t no bail 'lowed in the first degree murder, £0 mebbe youwll have to stay in jail & while, for_ what I've got to do'll take time. But I kin git Doc Hood 10 fix it with the district attorney not to have vou formally indicted till I go to him and prove you ain't guilty. “Oh, Geoff! Can you do that?" Rupert cried. “Can you prove it? “T kin in a few days. mebbe a week or so,” Geoff replied slowly, and a look of pain had come into his mild brown eyes. “There's one last s‘ep that'll free you, sure, but I dcn't want to take it If there's any otler way out. 1f therd ain't—well, tnat step’s gotta be took. 0o matter what happens, Mr. Ashe, I pledge vou my ‘word you won't never go to trial. CHAPTER XVII The Boy Who Lost. ‘Rupert Ashe broke down utterly and buried his head In his arms on the table, sobbing in uncontrollable abandon. Geoff knew that it was as much the reactfon from the nervous | straln of the past few davs as the surety of his freedom from the charge, hanging over his head. Wisely, he let the boy alone to re-| cover himself; yet he was touched, nevertheless. He had always been aware of the opinion of most of his neighbors, and it hadn’t troubled him any. They thought him a good car- penter and stonemascn, the best in the country, maybe, as his father had been before him, but cranky and terrible set in his ways; and some of them figured he was a mite crack- ed. going around the country and picking up all kinds of stray animal dirty and maimed and starved and &enerally worthless. Only the fat, sleepy-eyed, little doctor had treaied him like @ real friend and one whose ideas and notions were of some use in the world, and now this rich city fellow who had been to college and Europe and all, and whom he'd seen shooting up summer after summer shrewd spindle-shanked little kid to a fine | Joune man—this here Rupert Ashe elieved in him! first of all in his trouble and as much as put his liberty and perhaps his life In his hands. But the task which confronted him loomed, a1l at once, colossal, and he knew that not a day or an hour might be wasted. The_public was clamoring for action. Police head- gquarters in the city which had swal- Jowed up their little community was ready to take command of the situ- atlon over the heads of the local authorities. The _district ' attorney would weicome Sergt. Eliot with his report, and speed him back with a warrant as soon as the magistrate could issue it. He must work, and work fast, if that final step of which he had spoken was not to be taken. Rupert ralsed his head at last, coughing in embarrased self-disgust. “I'm sorry, Geoff.’ I didn’t think I ocould ever make such a fool of my- self as this, but when I came to you, although I knew you'd do your best to help me, I hadn't any ldea that you had a way of actually proving my innocence up your sieeve! Is there anything I can do?" “Yes, three things, after you drink this here coffee.” Geoff poured out a steaming cup and brought it to his guest, then sat down and began re- moving his shoes. “I'm goin’ to take a swim in the crick and git into my good clothes s0's T kin make the next train to the city. First off, T want you to promise me that you'll come over twice a day reg’lar and feed and water the mare and the dogs. If you got took up, which is likely, don't forgit in the excitement ’'bout your folks and Miss Millie and all to fix it for one o' the men from your pa's plade that you kin trust io take care o' 'em stiddy tll I git home agin.” “l promise, Geoff. I'd move all three of them over to our stable now, but It might make the neigh- bors talk. They shall ant . for mnothing while you're away.' “All right. Now, when I get cooled off in the crick so's I can think clear I goin_to write a letter, and T'd @ for you to take it to Doc Hood. Uo_as roundzbout a way's you kin fnd to his kouse; I don't want no more folke ‘0 ses you than you gotta et up vith." Geoff picked up his ad rose. “After that, I'm In’ to ask yeuw to do the hardest thing ot sll; go home and walt, If Sergeant Eliot should come for you with a warrant, don't make no fuss, but traips» right 'long with him over to the county seat. Mebbe he'll tele- hone to L'oc Hood afore you start, ust tellin’ nim what's happened, and "Il put it in this here letter to him 1o git word to Miss Mille. Don't try to see her in the meantime, but while I'm takin’ my swim you kin @t here and write her a note that I'll put In with my letter to the Doc it you like, and he'll make sure it o%'ra the bast 850Ut tn the worl P re the scout in Geoft1" aried Rupert . & brokenly. I de- | He'd come to him | don't know how Tl ever thank s h “Never you mind ‘bout that now," Geoff Interrupted. “If you'll take my sdvice you'll git your pa aside sqon's he comes back from the city and tell yim all 'bout a week ago tonight, ust as you told it to me. Then tell im you come here koday and every- thin’ "you kin recollect I said to you. if youre took up, vou ask him to sec | Doc Hood afore he so much as gits { his lawyer on the telephone—I move conslderable quick, now, If I'm { goin’ to ketch that there two-twenty. { Here's a pen and paper, and the ink's |over on_ the shelf. ! Dr. Hood had paid a long and | wearisome round of visits that morn- Ing in his rattletrap liitle car and eaten his noon day meal at the farm- house of a patient far inland. It | wes mid-afternoon before he drove |Into the stable where once his old | horse and buggy had reposed. He | was hot and tired, and all day long Geoff's cryptic remark about the mur- ! der had rankled in his puzzled brain, |1t was in vain that he recalled every | point of Zoe Dawn's story: it re- | vealed ~ nothing that he had mot | known or suspected before, except- |ing that Lane had planned with her {to ruin Benkard and then tried to {buy her silence. Benkard had long been threatened with death, but they had known that since Dunn’s account ‘of the mnonymous letters and these couldn’t very well be traced at this late date with only the evidence in {hand. Yhat in thunder had Geoff meant by saying that no murder had | been committed? The doctor passed through the back entry and looked into the kitchen to nod a greeting to Miss 'Martha, the elderly woman who kept house for him. “Then he proceeded to the office, wriggling out of his linen dus- ‘ler as he went. | The room was empty, but propped up against a fat medical book on the center table was & bulky envelope scrawled laboriousiy with his name. He did not recognize the writing, but with a sudden premonition, he dropped the duster on the floor, tore wper the envelope and read:— Dear Doc . You told me I was in Benkard case with you & could not quit. It has took a new turn & I am on it. Cant tell wether back 2 days or 2 wks will write or fone you. If you should meet up with Adrain Middleton pleas tell him I been sent for Long Island City job but will be along later dont lét no- body know what I am up to, i | | | | onsarn him!" Doctor Hood ex- claimed aloud. “How could I let any- know what he fs up to when know myself? What's more 1 don't believe he does, eithe; The good doctor had reason to change his mind, however, for as he stood staring from the extraordinai epistle, he had just read. in one han. to the little folded note in the other, the telephone rang. Dropping both missives on the table, he went to the instrument and took down the re- celver. “This is Dr. Hood?' A dignl- fled but shaken masculine voice came |to him over the wire. “My son Ru- pert wished me to get Into immediate communication with you. He has just been arrested on suspiclon in connection with the murder of Joseph | Benkara.” { At that precise moment the medical examiner's self-elected deputy was | seated behind the ralling in the homicide bureau at police head- quarters® A grizzled elderly man of massive build was looking him oyer with amused tolerance, from the hiny vellow shoes to the straw hat with its nicked brim. “No, sir” Geoff replied respectfully but doggedly to a question which had {ust been addressed to him. “I ain't carrsin’ no creedentials nor no badge land T won't need none when Detec- tive Allen gits here. If you'll let somebody tell waitin’ to_find out when he wants the new floor laid in his cellar. I eckon he'll understand. “Allen? Let's see.” The Inspector rummaged among some papers on his desk. “I loaned him to the med- | ical examiner on a murder case out on Long Island/ so you may have rather a long wait” “Is that so, #ir?" Geoff's calm, bo- vine eyes surveved the veteran with no change of expression. “You've got 'nother detective here that I'm better 'quainted with but I didn't &'pose he'd be ‘round, so I asked for Allen first. The other one's name is Lyons. “Then_ you're from Sunny Beach, are you? Hanged it T don't think you're the hick Sherlock—h'm!” The inspector turned suddenly to a younger man seated at another desk. “Kirk, get Lyons, will you?—When did you come up to the city?" “On the two-twenty train, sir.” Geoff saw that further attempts to preserve an incognito would be fruit- less. “My name's Peters and I'm.a carpenter and mason when I work at my reg’lar trade and don't git to mixin’ up in other folks'‘business. “You're some fast worker when you do that, though!” The inspector laughed and held out hiy hand. “Lyons has been telling me about you. It was you who got the first dope on that row between Lane and Benkard, wasn't it, and figured it i woman for help to get even? Glad to know you.” l “Thank you, sir.” A suspicion of a twinkle appeared in Geoff's eyes. ] “Kinder looks as if I got the wrong I sow by the ear, though, don't {t? I I “in’t makin’ no reference to the lady, i but T was thinkin' o' the arrest the district attorney’s feller made this afternoon. “How the devil do you know that?” demanded the inspector. ‘“Have you had the doctor on the wire since you , but I s'posed mebbe he'd Rit a rrant soon, seein’s some ac- tion was necessary, and when you asked me what train I got I figured he'd started somethin' and you want- ed to find out if I'd got wind o' it. I'm just up here on a little errunt for the Doc—'Afternoon, Mr. Lyons.” “Hello, Peters." Lyons nodded briskly. = “Inspector, this is the man— “l know. I've just had a sample of it.” His superior interrupted with a chuckle. “Take him over to your g]u!k and see what you can do for our D. A. has stolen & march on you, I understand,” Lyons remarked when Geoff had followed him across the huge room to his own particular corner of it. “You got one on me, though: when 1 steamed the Dawn woman up, at your suggestion, to b lieve Lane had double-crossed her, I thought you expected her to come clean to us, but instead you were fixing it for her to Bfl to you with the straight dope.
