In the Supreme Court of the Dmited States yesterday Justice Brewer delivered the decis- of the court in two habeas corpus cases— one involving the question whether a soldier who enlisted in the army under age has the right to be discharged on the ground that be entisted as a minor and the other involving th right of a soldier who enlisted while over the age prescribed by law to be discharged because he enlisted when over age. David Perry, from the circuit court of the eastern district of Missouri, the evidence jowed that Morrissey enlisted in 1883 while a minor and deserted after serving loss than a month, In 1889, when he became of age, Mor- | rissey reappeared and demanded his discharge from the army on the ground that he was a minor when he enlisted.
