Y.. on Wednesday, between Pence’s “Maffett Pony” and Phillips’ “Oid Man’s Mare.” mile heats, best three in five, for & purse of $400. Both horses trotted with ran- ning mates. By two o'clock im the afternoon quite a number of persons had congregated at the park to witness the contest. the pool selling the “Maffett Pony” was the favorite, the odds being fivetoone. At 3 o'clock the horses were brought up, the «-Maffett Pony” winning the pole. First Heat.—Hoth horses got off finely the first time, and both teams went up soon after leaving the score. The ‘Maffett Pony,” Row- ever, soon got to work again, and turned off the ground at s rapid rate, winning the heat in 3.01, the “Old Man’s Mare” evidently no match for him. Second Heat. —Both started well, coming down the t Ata thondering gait, the “Old Man's Mare” deing better than in the previous heat, but failing to lead her competiwr. FrxaNciaL.—The New York money market though Jees active than jast week, as respects demand loans shows more firmness in rates. Tbe Western banks are beginning to draw down their balances to s moderate extent, and there ig some movement of currency South- ward. The accumulation of paper, which has naturally occurred during the rise in the rate of interest, has cansed more or less pressure for aiscounts, and the banks find they can em- ploy their means,in discounting prime paper at Gaz per cent. The Commercial of yesterday afternoon, says:—Under these circumstances there is a Strong tendency toward a6 per cent. market on call loans. Most of the banks are at present lending on call, on mixed collaterals, atSper cent; but itis evident, from the tone in banking circles, that one or two leading in- sutulions Sdyancing the rate would cause'a general 6 per cent. rate. Some of the private bankers bave put their loans te 6 per cent., and, so faras we , Without having any loans paid in. This upward tendency of mone: has presoces a sympathetic effect on the stoc! market, which the “bears” are attem; to augment by throwing stocks upon the market. The market yielded at this morning’s board under this sort of pressure to the extent of 83, per cent , and more disposition Was shown to put out “short” contracts. Patrick O'Neil was the first prisoner placed in the dock. Mr. Thomas Knight, before the prisoner pleaded, moved that the indictment be quashed, on the ground of misjoinder of count, and that the offense was committed in Welland county, and therefore could not be heard in the sonny of Yerk, which was one of the counties visited. Mr. R. A. Harrison contended that his learned fmend had SL aagees & wrong construction on the interpretation of the clause, and that, as to the second ground, his Lordship had overruled that decision im an application of the same na- ture yesterday. A lengthy legal argument here took place be- tween the counsel. Mr. McKenzie said :—I would ask your Lord- ship to allow me until to-morrow to consider which course I should adopt in this case. Whether I should euter a demurrer or allow the prisoner to plead over. Hon. J. H. Cameron.— Better be careful how you demur. In the case of the Queen ys. Sweetzer, which is reported. and in which I defended the prisoner, it was held by the learned Judges that unless the demurrer had been successful the sentence would have to be carried out. ia Lordship—Very well. 1 have no objec- ion. ‘The prisoner was then removed. deen Magarth was then placed in the jock. Mr. McNabb, in @ short address, opened the case for the Crowa. He said it could be proved that the prisoner, on the first of June, was seen with whats known as a Fenian rifie in his ym, near Fort Erie, and that he was a Fenian by the account which he gave of himeelf. Alter the examination of a few witnesses, his Lordship, addressing the jury, explained that the evidence showed the prisoner to be a British subject, and he could not, therefore, be tried as at present directed. He there- fore directed the jury to return a verdict of acquittal. ir. McKenzie then submitted that as a Brit- ish subject should not be tried twice for the soe e oeeare, he should, therefore, be dis- cbarged. Mr. R. A. Howson said the Crown has fur- ther evidence. The prisoner, if he is tried again, ‘will not be tried as an American citi- zen. The Court, at 1 o'clock, adjourned until 10 o’clock to-morrow morning.
